State has and always will regulate marriage. We regulate how old you have to be to marry. Different states allow for younger people to marry with parental consent, etc. We regulate the marriage of people to closely related. The only question is if sexual orientation is a protected class that would bar the states from regulating it as far as marriage goes. The federal government does not have the power to regulate marriage, that is left to the states. They do, however, have the ability to define protected classes under the 14 amendment's equal protection, which extents to marriage doctrines in every state.
