I agree. But I don't see smoking on private property as an area that government needs to be involved in.

Yes, you can claim it's a health hazard, but it's not inescapable. If you don't want to eat in a restaurant that allows smoking, then you can go to a restaurant that bans it.

I don't see texting and driving as analogous. I cannot choose who I drive next to or who I share roads with.

I don't see seatbelt/helmet laws as analogous either. My understanding of those laws is that they were created for healthcare expense reasons. Banning a smoker from smoking in a certain area is not going to make him quit smoking altogether. The health risk lies in the act of smoking, not in where you smoke.
