This an awful situation. I hope none of you have to deal with a severely autistic child (and that's what he is). He should be Institutionalized, and no longer able to attend school. Jail will do NOTHING for this kid, abd it will cost the taxpayers a fortune.

He had PTSD, was a foster kid, etc...the blame to me is on the crackhead birth mother.

ASD is not his major malfunction. He was also diagnosed with:

Oppositional defiant disorder(ODD)
Defiance toward parents, teachers, or authority figures.

They blame others.
They are vindictive.
They are revengeful.

Contributing factors:
Personality
Parenting


Intermittent explosive disorder
Sudden explosive behavior with no thought of consequences.

They are violent with the intent to harm or kill.

Contributing factors
Passed from parent to child genetically or environmentally.

He has been with this family since he was an infant, which means it's not environmental and violent behavior is in his DNA. He doesn't like rules. He's willing to harm or kill to get what he wants. He's low intellect, but he understands right from wrong. Unless he's a sociopath. Either way, he belongs in jail.

All of the "put him UNDER the jail" posters lose sight of the ball here.

Jail serves two basic, parallel purposes: protecting society and punishing the wrongdoer.

Here, this kid cannot be "punished" because he simply lacks the neural hardware to UNDERSTAND and process the concept of punishment. As you say, jailing him will have ZERO effect upon his behavior. The other goal (protecting society) can be better-served by segregating him in an environment where he cannot hurt anyone else in the future.
