Part of the problem was that there wasn’t a clear majority owner, and that a higher bid was spurned because one of the ASG members was Ted Turner’s son-in-law. The person behind the higher bid (David McDavid) ended up suing.

And all kinds of sordid details came out during that process. The Spirit weren't qualified to run a lemonade stand.

It was a serious black eye for the NHL to have ever allowed a sale to such a shifty ownership group. But, if memory serves, the NBA approved them first, which kind of put the NHL at an impasse. Looking back on it now, it's not terribly surprising that the NBA did this, because the Hawks were treated vastly differently than the Thrashers ever were by the same ownership group.
