In Utah a woman can give the child away without informing the father. This is one issue that never gets the "level playing field" attention it requires.

I agree with this. No woman wants a man she doesn't consider her partner seeing her exposed that way and in such a vulnerable position.

I do believe fathers should have equal rights to the child. No mother should be able to give away a child without the father's agreement.

Agreed. What happens when there is a medical issue and the father isn't told or a medical split decision needs to be made? Is it fair for only the mother to make that determination?

If my wife hadn't wanted me in the delivery room (for whatever reason), I would have obliged and waited outside. It's a relatively new practice to have fathers there, anyway.

I don't know that there needs to be (or should be) a law for this, however.

my dad was kicked out of the hospital when my sister was born for spazzing out at the doctors

I can't see how it would be interpreted differently even for married fathers. HIPAA is pretty clear. If the patient (wife) doesn't want anyone in the room, she has that right.

Just like the wife couldn't demand to be in on his vasectomy. The fact that it's a childbirth is irrelevent (per HIPAA).

If they were married then I would have a problem with it. My mom had me by c-section and chose to go under. My dad went and ate breakfast at shonny's during the operation.

Let's say you were forced to squat on a table in a hospital with a speculum inserted in your anus is hold it open while you attempted to shat out a 6 lb baby. You might love your wife but not want her present to witness this.

Forcing a woman to allow unwanted spectators while she is giving birth is selfish and unnecessary for the father to have equal rights.

Does the baby being half his eliminate her right to keep her healthcare information private if she so wishes? Maybe she's dishonest and hadn't disclosed a previous abortion, miscarraige, or uteran cancer to him, or a past HIV diagnosis that has to be discussed during the delivery. Yes...she may be a count for lying, but it would be the hospital that is financially liable for allowing that information to be disclosed to the husband.

$50,000-$1,000,000 penalty PER disclosure. Why would a hospital admin (i.e. me) ever allow that chance?

What they are doing in the room is irrelevent. If PHI is disclosed without her permission, the hospital is fricked!

she was probbaly exposed that way 9 months prior
