Labor Unions to be exempt from Obamacare Tax?

"Weeks after denying labor’s request to give union members access to health-law subsidies, the Obama administration is signaling it intends to exempt some union plans from one of the law’s substantial taxes," reads the report.

Buried in rules issued last week is the disclosure that the administration will propose exempting “certain self-insured, self-administered plans” from the law’s temporary reinsurance fee in 2015 and 2016.

That’s a description that applies to many Taft-Hartley union plans acting as their own insurance company and claims processor, said Edward Fensholt, a senior vice president at Lockton Cos., a large insurance broker.

Insurance companies and self-insured employers that hire outside claims administrators would still be liable for the fee, which starts at $63 per insurance plan member next year and is projected to raise $25 billion over three years.

I'm all for letting them do this. It will be amazingly hilarious when a Republican is in power and unilaterally revokes the unilateral exemptions granted by the administration.

They should retroactively tax them as well to make up for the tax break IMO

I'm seriously pondering whether someone should be filing a lawsuit now over these unilateral exemptions.

I can just see the epic legal showdown that occurs when they are revoked in the same manner, and all those receiving exemptions try to claim the president doesn't have the authority to perform a unilateral act.

Will this be the straw that broke the camel's back? I think this will open the door for more lawsuits and push back from the citizens.....to what extent, I don't know.

No shite... I would hate the precedent that gov could pass a law today and retroactively tax me from 2011.

Clinton did it his first year in office. Taxed dead people. Hell I guess if they can vote, they can still pay taxes too.

It's not really retroactive. It's just making them pay the taxes that they skipped out on.

They'd just be taxing them on taxes they should have paid but didn't. I have no problem with it.

Through no fault of their own. They were following the law. What will stop the gov't from raising rates to 50% then retroactively taxing you the difference going back to inception?

I said in a post a while back that Sebelius had nearly unlimited power re the ACA, via "at the discretion of the secretary."

It seems I was wrong. It appears she has absolute power re the ACA, to add, remove, amend, addend, interpret, you name it.
