Ingham County judge rules Detroit bankruptcy be withdrawn

quote:

Ruling that the governor and Detroit’s emergency manager violated the state constitution, an Ingham County Circuit judge ordered Friday that Detroit’s federal bankruptcy filing be withdrawn.

quote:

It’s cheating, sir, and it’s cheating good people who work,” the judge told assistant Attorney General Brian Devlin. “It’s also not honoring the (United States) president, who took (Detroit’s auto companies) out of bankruptcy.”

I have a feeling federal bankruptcy laws and judges are going to smack this judge. But, you are seeing a slice of the fiefdom mentality/insanity at the state court level with this type of talk.

I don't know beans about the Michigan constitution but this reasoning is just beyond the pale.

It's pretty obvious the public employee unions own that judge.

Did any of that matter with GM?

Why would it matter with Detroit?

Obama's got union donors to oblige.

I guess it's not "honoring the president" to acknowledge the existence of math.

“It’s absolutely needed,” said Judge Rosemary Aquilina, observing she hopes Gov. Rick Snyder “reads certain sections of the (Michigan) constitution and reconsiders his actions.”

The judge said state law protects pensions from being “diminished” but there will be no such protection in federal bankruptcy court

i wonder what this judge would say if the Michigan constitution outlawed interracial marriage

Detroit is going bankrupt and there is nothing this thief can do about it.

Based on her comments the judge is obviously no Oliver Wendell Holmes. But it was a great move by the pension fund managers to sue the emergency manager/Govenor & not the city. They want to keep this in state courts.

Right.

When is the last time you saw a county judge overrule a Federal Bankruptcy Judge?

Does this judge have no concept of jurisdiction? How did she get to be a judge?

it's slightly interesting in that the bankruptcy, being federal, stays any state court proceeding

i'm curious what will be the effect of a state-based injunction on the individuals pushing the bankruptcy

Why do I have the feeling this was a bargaining chip all along?
