Family of slain Chicago officer files suit against Miss. gun shop

LINK

quote:

CHICAGO — The parents of an off-duty Chicago police officer who was shot to death three years ago shortly after returning from Iraq announced a federal lawsuit Wednesday against a Mississippi gun shop, saying it was the origin of the weapon a gang member used in the killing.

quote:

The lawsuit was filed by the Brady Center to Prevent Gun Violence on behalf of the Worthams in federal court in Mississippi. It alleges that Ed’s Pawn Shop & Salvage Yard “knew or should have known at the time of the sale that the sale of the handgun to Michael Elliott, a straw purchaser, was illegal, as Elliott was conspiring with a gun trafficker.”

quote:

The lawsuit says that even though Elliott could legally purchase weapons, the fact that he was a first-time buyer who paid $1,500 in cash for three weapons should have raised suspicions.

frick these pieces of shite... I'm sure their son would be ashamed that the family was doing this.

Yeah, if he had not gotten the gun from this particular individual, I'm sure he would have given up on trying to get a gun.

People are either getting incredibly stupider by the day or they are greedy as heck and just trying to get a paycheck. I just can't figure this shite out. Maybe it has to do with the colder temperatures freezing the brain, perhaps slowing things down and causing misfires. OR... It's purely agenda driven, and they really just don't care how retarded they appear because the end justifies the means.

I always love the "knew or should have known" lawsuits. If everyone knew or should have known, we would be prophets and the son would have known that a criminal was going to shoot him.

Well, at least they didn't get to file in the People's Republic of Chicago (or California, New York, Vermont, etc.).

Given that it's in Mississippi, if it ever does go to to trial, any jury (or judge) verdict will be proceeded by at least 5 minutes of pure laughter.

Whats fricking ridiculous is the gun shop owners will prob have to settle due to how much it will cost in order to fight these baseless claims...

I really wish there was a law that whichever lawyer loses the case, they would have to pay the others fees. Maybe it would stop all of the frivolous lawsuits.

This.

Pick on a small pawn shop owner who doesn't have the means to wage a court battle.

I don't think the shops insurance would pay out for a claim of negligence on the owners

I'm sure that an Obama appointed judge would rule for the plaintiffs in short order.

dangerous president is it goes anywhere. Next a car dealership could be liable for selling a car to a drunk driver. or wall greens is liable for selling a syringe to a drug addict that ODs.

Then the reverse would be discrimination. If the pawn shop did not sell the guns to, as the article says, "to a legally qualified person", because of "profiling" the buyer, then you would have a racial discrimination lawsuit on your hands....

IMO, just another frivolous lawsuit whit a clear agenda...

It would be in their interest to defend against the payout though.

This is so stupid though. Gun shop should counter sue the State of IL for letting the homicidal gangbanger roam the streets in the first place.

This lawsuit will not survive summary judgment.

Pretty obvious all they wanted was a media story, likely to gin up additional support for the Brady Campaign and Bloomberg, they don't give one frick about the slain officer or his family. Just like the Newtown people, they are nothing but props to be used to advance a political agenda by any means possible.

re: Family of slain Chicago officer files suit against Miss. gun shop

More info from a Chicago newspaper. I am interested to hear the justification angles federal prosecutors will use to support their "should have known" claim.

LINK

quote:

"When I read about this, it made my stomach turn that this shop owner was so lax," said Richard Barrett, like his father a gun owner. "If he had taken care of business, it would not have happened. … Everybody paints us as a red state, (that) everybody is a hunter and has Hank Williams Jr. playing on all the radios.

"Just because people like guns around here and enjoy hunting doesn't make them devoid of common sense," he said. "We're not bringing this case to change laws. We are bringing this case because Thomas Wortham IV is no longer with us. His family lost him because a pawnshop here in Mississippi put profits over people."

quote:

It was there, at Ed's Pawn Shop and Salvage Yard, that the Smith & Wesson pistol used to kill Wortham was purchased. Quawi Gates, a Rust College student in Holly Springs, Miss., who had a gunrunning operation on the side, had asked an acquaintance, Michael Elliott, if he wanted to make some quick cash.

Gates' criminal record prevented him from buying guns, so he had lined up several college students to make the purchases for him for $50 to $100 a weapon. Elliott was stressed out over his hospitalized infant daughter and agreed to buy three guns for Gates in return for $100.

quote:

Gun sellers are not under any obligation to complete a sale if they are concerned, said Thomas Ahern, the federal Bureau of Alcohol, Tobacco, Firearms and Explosives spokesman in Chicago.

"They do not have to make a sale if they feel that it's a straw purchase taking place," Ahern said. "I equate it to a bartender. If a person comes in a bar and he is obviously intoxicated and he has a fistful of money, you could make that sale of a drink. But you have an obligation to refuse service to him to protect your business and the public."

According to the lawsuit, Ed's Pawn Shop sold an a total of eight guns to buyers recruited by Gates for the trafficking scheme.

"Ed's Pawn Shop took no reasonable steps to implement … reasonable precautions or to otherwise alter their business sales practices to minimize the risk that they would supply the criminal racket," the lawsuit alleges.
