Tax benefits aside, what legal benefits that you and Mrs.VOR enjoy could any couple (same sex or hetero) not recreate through private legal documents? There probably are some, but I'm not sure what they are.

We've established that couples can contractually bestow benefits.
They can pass money to their designees through trusts and wills.
They can share domiciles and expenses.
They care share medical information.
Now we know they can share insurance bene's.

So at the risk of "acting dumb," do you have anything else to say?

When I saw your original post in the negative, I assumed you were speaking from your pov . . . if that makes sense . . .

As a matter of fact, most things other than tax benefits and, perhaps certain other benefits derived from the state (SS payments?), can be provided for contractually . . . wills, powers of attorney, medical powers of attorney, etc., should cover most things. However, some situations can be problematic as people move across state lines. For example, on vacation if one of the couple becomes gravely ill or injured, unless they have all the paperwork with them and in a form that state or, more specifically, a particular healthcare provider may not allow full access or decision making decision making power (don't know how it is in No. Carolina).

Frankly with HIPPA, full access or decision-making for gay partners was a significant issue. During the Clinton years it was a gay unfriendly mess. But clarifications issued during the Bush and Obama Administrations make it extremely unlikely there would now be any impediment to access. Decision making would probably the same, but would best be handled through a Living Will, IMO.

Power of attorney would be the other option.

I would think that a "married" same sex couple would refuse to go to a state that doesn't recognize same sex marriage.

I would think they would prefer to go to a state that recognizes same sex marriage and spend their time and money there to show support for that state's recognition of same sex marriage.

Well, many of the benefits that derive from marriage (federal taxes, ss, etc) would not be solved by moving. Plus, most people have to go where they have the best employment opportunities.
