I'm assuming she was. Women as a whole have lost my trust when it comes to these types of cases. More often than not they're lying so I'm going to assume that they're all lying until I see physical evidence. A woman's account of an accused rape shouldn't even be admissible in court.

Of course, I also know people who find the "easy target" super drunk chick in the bar and proceed to hit her up while also getting drunk themselves. Not sure where that falls here

This, once most guys get to the point of blacking out and losing consciousness you're not performing, hell I think we've all had that point where you're on a date (usually in college) and you start to realize that might be an issue later in the evening and you switch to water- it usually happens after you can't rise to the occasion once (say after a night of knocking back whiskey cokes or trading shots).

Is there any evidence that he was intoxicated? If he was drunk then yes, sounds like they raped each other.

Sounds great on the surface, but that is a slippery fricking slope. What if you're legitimately raped, lose in court because it can't be proven beyond a reasonable doubt, and then get prosecuted for a false accusation.

I'm sorry, but I'm not going to support anything that makes it more difficult for real rape victims to file charges.

we all do a lot of dumb shite when we are drunk. She might have consented and the guy might have been drunk to, what is to say that she didn't rape him? You are still responsible for your actions when you are drunk. If I drive drunk and get pulled over, I can't blame alcohol affecting my decision to drive and get out of it, if I kill someone when I am drunk, I am still responsible for the aftermath. Why is sex any different?

Were they both drinking at the bar and then left together intoxicated? Because after that if there are no witnesses or physical evidence then its word against word and nothing should come of it.

its too easy to ruin or slander someones name by simply yelling "rape!"

rape is a crime in which you are guilty until proven innocent, instead of innocent until proven guilty

with rape, the victim doesn't have to prove you raped her, you have to prove you didn't

rape cases are always arse backwards

The only reason he wouldn't be drunk is if he's the biggest pussy in the world? I'd say that going to a party and having the discipline not to get heavily intoxicated is a pretty good trait to have.
