Was It Rape? Or Was It Regrettable Drunk Sex?

I saw this article, figured it would hit a few OT triggers. Especially SFP... someone send up the batsignal.

I see his face—he’s on top of me, he’s inside of me, he’s sweaty. I vaguely realize what’s happening, and I explicitly realize that I don’t want to be where I currently am. Despite my confused state, I have an overwhelming instinct to leave. I get him off of me, and look for a way out. I walk into his roommate’s single, still naked. Wrong place. I walk through the common room, still naked, out the front door and into the hallway. I walk down the hall. I sit down and lean on a wall, maybe someone’s door. I black out again.

The next morning, I wake up alone in a foreign common room in a t-shirt that isn’t mine. I have bruises staining my sore legs, evidence of a nasty fall or two—evidence to anyone I was with that I was too drunk to consent. Still drunk, head pounding, throat dry, I quickly remember, in blurred bits and pieces, what happened. I’m confused, I don’t have any of my belongings, and I want to go home. So I do.

I'm so glad this shite wasn't so prevalent when I was in college. 90% of us would be fricked.

If she isn't lying, that sounds like sexual assault. And I'm almost as quick to throw the bullshite flag up on these as SFP.

If she was actually in and out of consciousness and wandering around naked not knowing what's going on, she couldn't consent.

these always boil down to this

girls cannot be held responsible for their actions while they are drunk

but guys should always be held accountable when they are drunk

both guy and girl are drunk, they have sex, girl regrets it, she screams rape, guys life gets ruined

this kind of stuff pisses me off

do we know the guys state? how do we know that he was sober enough to consent?

what if they both raped each other?

Again. I know you to be level-headed and I usually come down squarely on the side of most of these "grey area hookups" being just that. Two drunk people fricking and the girl feeling bad about it later. *If she's being truthful* she was blackout drunk and wanted to get away badly enough to wonder into someone else's room, the common living room, and a public hallway buck arse naked.

Don't stick your dick in a girl that drunk. It's not that hard.

If you're sober, I absolutely agree. However, if both parties are drunk, then that kind of inhibition goes out the window.

So you are allowed to get blackout and assume that people are just going to take care of you, and if they don't you have no fault in the matter? Give me a fricking break. No one has the balls to take responsibility for themselves anymore. Its never my fault, only always your fault! Maybe this situation shouldnt have gone down the way it did, but to say that the girl has no fault in the issue because shes too stupid to know when she is getting sloppy and not responsible for what happens is insane. I guarantee the guy was drunk, is he also not at fault because he was drunk as well?

Agreed. Assuming it is all true, and that is a big assumption, the guy acted like an idiot and potentially like a criminal.

Okay fine. I'm just going off what's available. But I've done a lot of drinking and a lot of drunk fricking, and if I'm physically able to put the work in I'm not too drunk to know what's going on.

again...if he was in the same state, why is he held to a higher standard than the girl?
