If both people are blackout drunk it's one thing, if one is and the other's nearly so er it's another.

Also if anyone had sex with her after she passed out, that's kind of unquestionably rape.

It's a necessary contradiction. Most criminal acts require the mental intent to commit the act in order to be convicted. So what's stopping someone who is interested in robbing a bank from taking some shots before hand and claiming that he only robbed the bank because he was drunk. that he never intended to rob it?

That's why every state has a law stating that criminal intent cannot be denied based on a defendant's willing ingestion of drugs or alcohol. The criminal justice system simply wouldn't work if people could get out of any charge by smoking weed or whatever before the crime.

But if both parties were obviously intoxicated then both could not consent and they both raped each other.

That's fair. I shouldn't have conflated the two. But still, "blacked out" is effectively out on your feet, to borrow a boxing term. You may be moving about, but by the time you're at the point where you aren't going to remember shite, you're generally impaired enough that it's more than noticeable. To casual observers--sober and drunk.

I have never had sex with a drunken woman while I was sober. Mostly because drunk people are annoying as frick if you aren't as well, and annoying white girl blabbering is a boner-killer.

I have, however, had sex many times when I was trashed and a woman was trashed. In no instance have I ever been accused of raping or assaulting the woman...mostly because we both know what the frick is up. It isn't difficult.
