Comparing your driving habits on a public roadway to a professional driver's habits on a Sprint Cup raceway is certainly valid and strengthens your argument immensely.
Thank you for that.
Thank you for that.

And you missed the point -
He will be charged, then charges dropped or found not guilty - civili action will lose.
Unless drug / alcohol test, etc, blow up on the scene.

I didn't miss the point, you provided a horrible example and I called you out on it.

You just don't get it - I can't help people like you.

no i get it...just understand that you provided a horrible comparison to what actually happened.

One witness who races in those vehicles said he heard Stewart hit the gas just prior to approaching the victim. Would that not qualify as negligent homicide?

oh no one witness...talk about the definition of anecdotal evidence...the guy was probably drunk

Zero percent chance he gets any jail time. The dude walked into the middle of the track and intentionally got in front of his car. His fault he is dead

If a guy is walking in the middle of the interstate and gets hit, does that drive get manslaughter too?

It was a professional driver who was in the stands. He will testify he heard the engine accelerate. I have no dog in this fight. I was just asking a question.

20 y/o kid with rustled jimmies leaves the relative safety of his race car, walks in the middle of an active race track, points at Stewart's vehicle Babe Ruth style, and in an deliberate aggressive effort he gets too close to the open wheeled vehicle. He sustains injury that leads to his death. The deceased is the only person in the video to show aggression. Mr. Stewart's use of the accelerator is consistent with the other vehicles on the track.
Very well explained and I agree. I have no issue with TS one way or the other but all of the TS haters on here or ignoring the fact that the other driver chose to get out of his car. He then chose to go running around the track to taunt other driver(s).
If he would have stayed in his car or walked to safety he would still be alive, period. He chose a more reckless path and paid the consequence.

How can you prove he accelerated? How can you prove he even saw him in the middle of the track until it was to late?
Posted on 8/10/14 at 12:42 pm to Jake88
Yes, because it happened where they come out of the turn!
Look at the video closely, the blue and white car in front of Stewart seemed to have to swerve, and the driver walking out there had to jump back. This is in a curve. Stewarts line of sight would have been blocked by the blue and white and a PEDESTRIAN outside of the car in front of him.
The dead guy was absolutely moronic doing that on a dirt track where traction is limited. He was a 20 yr old kid trying to upstage a seasoned veteran.
Blaming this on Stewart is pitiful of anyone and they should be opened to slander suits if this keeps up....
Just think for a second. Going thru a curve with a car in front of you and someone standing on the outside of the lane is BLOCKED by the car in front.....only brain dead idiots would blame this guy's death on anyone but the dead guy.

I"m not taking a side in this. I really don't care. I was just curious.

I'm sure there are 'witnesses' who saw Tony Stewart go in reverse to run over the kid again to make sure he was dead

Americans always wanting to blame someone else for their actions.

it was dark and dude was wearing all black. how stupid do you have to be to walk right into the traffic?
Posted on 8/10/14 at 12:50 pm to Phat Phil
The guy ran down the track to Tony Stewarts car. He almost ran into the 45 first.
It can just as easily be set if the dead guy hadn't acted so aggressively after getting spun, he would no doubt be alive today.
