Comparing your driving habits on a public roadway to a professional driver's habits on a Sprint Cup raceway is certainly valid and strengthens your argument immensely.

He will be charged, then charges dropped or found not guilty - civili action will lose.

Unless drug / alcohol test, etc, blow up on the scene.

One witness who races in those vehicles said he heard Stewart hit the gas just prior to approaching the victim. Would that not qualify as negligent homicide?

Zero percent chance he gets any jail time. The dude walked into the middle of the track and intentionally got in front of his car. His fault he is dead

It was a professional driver who was in the stands. He will testify he heard the engine accelerate. I have no dog in this fight. I was just asking a question.

Very well explained and I agree. I have no issue with TS one way or the other but all of the TS haters on here or ignoring the fact that the other driver chose to get out of his car. He then chose to go running around the track to taunt other driver(s).

If he would have stayed in his car or walked to safety he would still be alive, period. He chose a more reckless path and paid the consequence.

How can you prove he accelerated? How can you prove he even saw him in the middle of the track until it was to late?

Yes, because it happened where they come out of the turn!

Look at the video closely, the blue and white car in front of Stewart seemed to have to swerve, and the driver walking out there had to jump back. This is in a curve. Stewarts line of sight would have been blocked by the blue and white and a PEDESTRIAN outside of the car in front of him.

The dead guy was absolutely moronic doing that on a dirt track where traction is limited. He was a 20 yr old kid trying to upstage a seasoned veteran.

Blaming this on Stewart is pitiful of anyone and they should be opened to slander suits if this keeps up....

Just think for a second. Going thru a curve with a car in front of you and someone standing on the outside of the lane is BLOCKED by the car in front.....only brain dead idiots would blame this guy's death on anyone but the dead guy.

I'm sure there are 'witnesses' who saw Tony Stewart go in reverse to run over the kid again to make sure he was dead

The guy ran down the track to Tony Stewarts car. He almost ran into the 45 first.

It can just as easily be set if the dead guy hadn't acted so aggressively after getting spun, he would no doubt be alive today.
