It looked like an accident during a motor sporting event to me.
And while people are still going to debate the point, Tony Stewart did nothing to be legally charged for.

I would imagine that when you get out of your vehicle on the track, no one else can be held responsible for hitting you.
I'm pretty sure the #1 safety rule for auto is racing is to stay in the vehicle if it safe to do so.

Agree with you Reb. Unless there is radio transmission from TS indicating he was trying to hit him. I have no idea if they have radios in those dirt races.

Involuntary manslaughter
Stewart was clearly displaying aggressive behavior and wanted to scare the kid or spray him with dirt or something. I doubt he wanted to kill him, but it doesn't matter - his reckless behavior resulted in the death of a human being.
Stewart is one of the best drivers on the planet and saw everything taking place at least 5 seconds before he got to the area. It's not like he had his eyes closed and suddenly opened them in the turn to try and swerve and avoid the kid.
Stewart was clearly displaying aggressive behavior and wanted to scare the kid or spray him with dirt or something. I doubt he wanted to kill him, but it doesn't matter - his reckless behavior resulted in the death of a human being.

yea, it was in no way the fault of the guy who walked literally in the middle of a poorly lit track with cars flying by

As I said, he should be punished in some way, but it will never happen.

Who is the local DA? That will have the biggest influence on all of this.
Also, if no alcohol or drug tests were taken from TS yesterday, that will come back to haunt the police.
When it is all said and done, I bet he will be charged for something - and he will be found not guilty or the charges dropped.
Example - I am playing golf...piss off the drunk guys playing behind me. They hit into me while I am 250 away - the shot hits me I. The head and kills me. I assumed the liability when I stepped onto the course. My estate would likely win a civil suit....but that is it.

Doesn't really matter Festus. I'm sure Ray Lewis has told every NFL QB he was about to kill them. Suppose one had a freak accident and does. Ray Lewis's remarks wouldn't get him arrested.

Aggression of hitting the throttle? There have been times where someone veered into my lane and I had to swerve and ACCELERATE to avoid hitting them and other oncoming cars. You don't automatically hit the brakes every time there is an obstacle in your way. Glad you guys can read Tony Stewarts mind. I'll say it again...fricking idiots.

It would be like if you got pissed off at them, intentionally walked toward them and then got so close to the guy that was swinging that he accidently hit you in your head
