No. The article said his family claimed he didn't have any cigarettes on him.

Sad thing is that he and his family seem relatively "normal". His kids aren't tatted up thug looking types and he seemed to be around. That sucks. I DO hope his family exacts a pretty large judgement from the NYPD. Whether he would have died in a few years or not is not relevant to this case.

that is definitely the best response, not to resist.
But at the same time, death is not an appropriate end point for getting upset at being arrested. Its just not. the cop clearly didn't apply appropriate level of force.
