In today's world, employers lay off employees on a minute's notice & do not think twice about any owed benefits unless pressed. Take everything coming to you.

Uh, I thought it was a law to pay employees for vacation days earned.

Seems like a lot of posters in here have never had a real job.

Days are considered earned or granted depending on your employer's policies or a negotiated employment contract. Your HR policies will clearly state whether they are earned days or a grant.

Additionally, many, if not most, companies prohibit use of vacation time once notice has been given.

You should get paid out for unused vacation days, so don't force them.

Most of the time if you take them, you will have to pay them back if the actual holiday hasn't happened yet.

If I was your boss and you tried to pull this shite , I'd just tell you not to come back. I don't know what you do for a living but pulling this kinda shite affects everyone you work with. Be an adult and honor your 2 week notice.

I'd ask too take the last Friday and maybe Thursday off.

I had to take PTO when I quit my last job since my lease was ending and I had to move. I told my boss that a month before I left though. By the last week I wish I took more time off since all I did was sit on my arse.

If you don't use them you lose them and you earned them so take them.

This just seems like a dick move. Why don't you just quit on the spot? You're burning bridges anyway pulling shite like this.

I don't allow people to work out 2 weeks. Thank them for the courtesy and escort them out of the building

We pay unused vacation though

What is your anniversary date of employment? If you are before your anniversary date and you take them, then the company has every right to take vacation pay back from you since you already notified them that you are quitting.

My previous employer had a similar system. What I did was used my floating holidays for the year then gave my notice when I came back.

Dude, it's February. There have not been 5 holidays this year, you are being greedy.

You are entitled to the days that have already passed that you worked on, but you should have let them know that when you have your 2 weeks.

Gave my 2 weeks notice today and my last day is Friday March 10 I have 5 vacation days that I won't get paid out for.
Would it be in bad taste to use any of them.
I'm sure they will gladly pay you to stay away.

Are you familiar with "Addition by Subtraction"?

There are ways around it, such as labeling the days as something other than vacation. But it definitely is not a "depends where you work" type of thing nor is it up to the employer.

It definitely does depend on where you work. Different states have different laws on this. In most states it comes down to what your employer's policy says.

It is not unethical but your company may want you around those two weeks to help with transition to the person taking over for you. Why not just work the last two weeks? You will still get paid for unused vacation.
