I was irresponsible and must have fallen out of my pocket. We tried to call it numerous times when I realized it was not in my possession but whoever had it kept on declining my calls. I was getting 3 rings to voicemail
It was not til later in the morning he/she turned off the phone.

Been there. I left my phone on the bumper of my trunk and went to town...same thing happened when my wife tried to call my phone. People suck.

Technically, couldn't you just not delete everything and hold the phone "hostage" with passcode and all to keep the thief from selling it to another person?

I have AT&T...they wouldn't be able to get a sim card for the phone that was stolen from me. Unlock the phone, and you're probably good.

No, he won't be able to access the phone. No hacker has been able to break through the iCloud lock yet. Some POS on Craigslist sold me a stolen iPhone before, and there is absolutely no way someone can use the phone after it has been wiped without the original owner's apple id.

Probably will be parted out, lots of money in iPhone parts and then you don't have to worry about people coming after you for selling a stolen phone.

If you have "find my iPhone" feature turned on with ios7 you automatically have the activation lock enabled. So when you remote wipe it the user will need your Apple ID password to get through the initial setup screens. This is an awesome feat as long as you are not using iPads in education/loaner programs.

I had friend who's phone was stolen and we traced it to an apartment. Not a building but we could zoom in enough to put it in a specific unit. BRPD showed up and said that they couldn't do anything about it.

Here's a lesson in locking your location services on so someone who steals it can't turn off the tracking of it.

Also if European Vacation taught us anything it's we should not keep private photos of our wife on things that can be stolen. If I were the OP I would check the seedy underbelly of the internet for said pics. Maybe able to trace the guy that way.

I had an Iphone stolen from my center console when I forgot to lock my wife's car. Find my Iphone does nothing once it's turned off. The "wipe" function may work as soon as they turn it on. I don't trust the whole locked phone thing though. We have a cell phone store in the ghetto around where I live that has a big sign that says "we unlock phones". Pisses me off, because I know it's just a front for people to sell stolen phones.

Well if you put a pass ode on it they wouldn't be able to do shite with it! It's annoying as hell to use it every time you go to use your phone but in a situation like this you would have a piece of mind.
