Happens all the time in divorce cases. One parent takes the kids across state lines (or to another country) to where the other parent can't see them at all. That is kidnapping.

Parents could have lost custody due to neglect or criminal behavior.

Then they take the kids and run and it is kidnapping.

Didn't that just happen recently with parents taking the kid from the grandparents?

I never understood why they call it kidnapping when the kid is awake or if its an adult that's taken.

Shouldnt they call it kidnabbing or adultnabbing...

if you don't legally have custody! then a lot of that shite is discretionary by the courts. they take in all the actions of welfare before the incident.
then, in some cases, if a person reports a kidnapping, thats all you'll ever here it as. but kidnapping wont be the official tag.

Because a government bureaucrat didn't approve of what you did with your own kid.

Also it's an asshat move to deprive the other parent of contact (barring a few extreme circumstances), although that's really a moral issue, not a legal one.

Something like this going on in Tampa right now. Grandmother had custody of two young boys, biological parents broke into the home, tied up the grandmother and kidnapped their children. Now they are on a sailboat the parents bought sailing towards Mexico.

I agree. It dilutes the meaning of the word. Just like using the word rape in the Kobe and Tyson incidents.

What happened may be illegal, but is hard for me to get too excited when it is mom and/or dad who takes the child. It is a custody issue not kidnapping.

Taking children for which you don't have custody is the essence of kidnapping, and becomed federal once you cross state lines.

Everything is common property where I live if you're still married, including the children. Nobody gets involved without a court order signed by a judge stipulating that specific agency stands by/picks up a child.

I know for a fact that's the case where I live legally. The PO'd husband or wife can take the child anywhere they want if they're still married.

That's all part of saying "I do", you did to every fricking thing.
