The cop should be arrested and tried. And he may not be convicted due to jury nullification (like many brutality claims).

Most states have mandatory blood draws in those types of crashes.
Not for the victim. The guy they were wanting to draw from was shown on camera being hit head-on by the car the cops were pursuing. He was not at fault, and the cops had full knowledge of that.

I tend to agree with the police in all situations, but in this case the nurse is 100% right.....
Not to mention, couldn't the nurse get charged with assualt/battery if she were to draw labs on the patient without the proper documentation?

We are all in trouble when the police don't even know the law, or at least make a call for clarification of the law before an arrest is made. That was purely emotionally driven by the arresting officer. He was pissed, and should have used his fricking head, but he didn't.

Doesn't this play into HIPAA laws? Patient privacy rights? I understand the notion of clearing a fellow officer, but they have to know that hospitals protect patient privacy above all else. Get a warrant, or go away.

Yes...drawing blood without implied consent is battery. The thing is...the victim's family can give consent if he is unconscious. The cops could have waited for them to get there and request the blood sample be taken.

Just like with 99% of other cop behaving badly stories, without the video no one knows about this, the department does nothing, and the cop continues thinking he was right in his actions.

i believe those were all hospital security guards. i wouldn't expect them to rebuke the authority of an actual LEO

To cops working side job at hospital I believe.
They said they were told by superiors to stand down unless the arresting officer got too "violent" with her.

Then you're wrong. Agree with them when they are right, and disagree when they are wrong. They aren't right in close to "all situations".
