In general, yes, but: What is the solution?

Most of those who do this have some mental problems.

If one obtains something of value for the fraudulent presentation, the question is more easy to answer.

Stolen valor act was ruled unconstitutional, they replaced it with another in 2013 where it is only illegal to do stolen valor for certain high profile awards with the intent to obtain money, property, or other tangible benefit.

As a Vet, and not part of the demographic you asked, I can say for a fact I really could care less about some guy with obvious mental problems unless there is some sort of criminal activity going on like ripping off charities or something. I am for some unknown reason, more put off by the 95-97% of people who really did serve and were in special forces like Marine Recon, Delta, Rangers, Seals, Navy Specwar. Is it really all that hard to tell the truth about your service?

Wow, they actually charged him with it through a New York state law. If he gets a decent lawyer they can get that law thrown out since stolen valor is protected by the first amendment according to SCOTUS.

I say instead of sending him to jail, they just sentence him to the same length of time compulsory military service.

Then he can brag all he wants about dressing up like a hero. They'll take care of him.

What's the sentence for this? If he isn't using it for monetary gain, I don't see how this should be a law.

ETA: just saw Dam Guide's post. Glad they rectified this ridiculous law

its pathetic when people claim to be in the military when they never have been, but I think its just as pathetic when actual military play up the fact they served just for attention or free stuff.

IF it is going to make a big difference,usually sales tax related, I casually mention a military discount...

No license plates, DL stickers, car stickers, etc.

At the very least you would think that he would have done some research on the basics for the uniform protocol.

Even without the uniform incongruities, you can tell from his near-smirk he's not a Marine.
