Colorado Supreme Court: workers can be fired for off-duty marijuana use

The 6-0 decision comes nine months after the state's highest court heard oral arguments in Brandon Coats' case against Dish Network. Coats, who had a medical marijuana card and consumed pot off-duty to control muscle spasms, was fired in 2010.
Coats challenged Dish and its company policy, claiming that his use was legal under state law. The firing was upheld in both trial court and the Colorado Court of Appeals.

I can agree with it if it is recreational, though as a business owner I wouldn't fire someone over that, but medical is insanity. I guess people can be fired for taking Lexapro or bi-polar medicine too?

Makes sense. How can they test and tell that a nurse didn't toke up 30 minutes before her shift caring for sick newborns vs yesterday on her day off?

This is only fair. Employers should have say in their employees weed use. If you don't like it, get another job. Also, muscle spasms LOL

This.
Employers right to ban recreational use of substances. They can ban alcohol if they wanted.
However, if a doctor prescribes Marijuana, I think its fricked up they can get fired for that if used entirely off-duty.
I can get fired for taking a bunch of pain killers I'm not prescribed to and failing a drug test, but if I have migraines and they are prescribed I am completely protected by law.

For what should you get prescribed it? I think only terminally ill patients should be prescribed it.

It makes sense if it was recreational. Companies for sure have that right. But can they fire people for taking medicine prescribed to them? I failed a drug test for opiates once because I had cough syrup for a bout with whooping cough. I was cleared after they consulted my physician and he confirmed it was prescribed and necessary.
If this guy was prescribed this for muscle spasms (which could be real or not, I have no idea) by a physician, I see no reason how that’s different from other medicine.
