Changing lanes in an intersection: illegal or merely frowned upon?

I was always taught changing lanes in an intersection was against the law. I have 3 siblings who've gone through drivers ed in the last 5 years, and they were all told it was illegal.

About a month ago, I was sitting at a red light. Right lane was open, and none of the cars in the left lane had their blinker on. I turned right. Was probably about 90% into the lane when a van switched lanes, hitting my driver's front fender and taking off part of the bumper. The other driver got the ticket for changing lanes in an intersection.

Now, Progressive (his insurer) says they can't find anything saying what he did was against the law. Apparently the only law the officer could site was improper/unsafe lane change. Because of that, Progressive says he was entitled to full use of both south bound lanes, and I'm 100% at fault.

So, does anyone know if there is actually a law on the books, settled case law, or anything else that puts the other guy at fault, or am I SOL?



TLDR: Is there law in Louisiana saying you shouldn't change lanes in an intersection, or is it just a preferred practice?

They put a solid white line about 100 feet from the intersection for a reason. Can't cross a solid line or change lines in an intersection.

If the other driver got a ticket, shouldn't he be at fault? Do you have documentation of the ticket?

RS 32:79 states:

Illegal, got a ticket for this once. Was cited as changing lanes within feet of a red light.

It's illegal. Doesn't stop an overwhelming number of dumb people to drive like they're the only ones on the road.

I live near a traffic circle and I'm counting down the days until something happens bad on that shite. People don't know how to use it. I remember when it first opened up, I was a senior in high school and they were having presentations on the damn thing in every high school and major business in the county on how to use it and they expect fricking tourists to no how to use it.

If your only going one exit over, stay in the right hand lane. If your going more than one exit, you have to use the left lane and it's up to the right hand lane to yield as you exit.

Can't change lanes within 150' of an intersection according to "ask the trooper" one morning on katc.

I know this doesn't really help your situation, but I'm 99% sure there is NO law against this in Texas. I think it's a myth they tell you not to do because obviously it isn't exactly safe. But I don't necessarily think it's illegal.

^^^. If there's no solid line and it's safe to change, I don't perceive a problem.

Just looked up the louisiana driving laws handbook. The best I can find is below

When changing lanes – Prior to changing lanes, you must check for traffic in the lane you want to enter and behind your vehicle. Changing lanes may include: changing from one travel lane to another, merging onto a roadway from an entrance ramp, moving onto a roadway from a yield intersection, or entering the roadway from the curb or shoulder. When changing lanes, you should:
• Maintain a safe following distance and look in your rearview and side mirrors to make sure there are no vehicles in the lane or entering the lane you want to enter and no driver is about to pass.
• Check your “blind spots” by turning your head and looking over your shoulder in the direction you plan to move. Blind spots are areas around your vehicle that you cannot see with your mirrors. Be sure no one is near the rear corners of your vehicle.
• Traffic ahead of you could stop suddenly while you are checking traffic to the sides, rear or over your shoulder. Do not have to look too long at any one time.
• Identify a 4 to 5 second gap in traffic, signal and look again in the direction of the lane change. Adjust speed and steer into lane. Cancel turn signal.

Do not change lanes while you are driving through an intersection or approaching an intersection as this is dangerous and illegal. Wait until you pass through the intersection to change lanes. There is already enough danger at intersections without the added threat of cars changing lanes. These locations often include controlled intersections, uncontrolled intersections and multiple shopping center entrances.


ETA: Page 87 of the handbook for that last part. Section is called Delaying or adjusting a lane change.

Illegal and it is usually marked by the solid white lines. This should be noted on the accident report.
