You aren't saying anything that makes this less murder.

So either he was armed when approached the vehicle or the confrontation ended, and he came back with a gun, and then shot Smith in the back?

Whether he did it on purpose or not he rear ended him. That happened. That is established. If Smith is armed it is because this guy followed and rear ended him.

If Judge Buras doesn't stop the proceeding, I'd expect the DA's office to seek an emergency writ from 4th circuit before it can restart. They don't want Hayes' attorney John Fuller hearing any more testimony today now that the indictment is in.

I've never seen/heard of anything even approaching this weirdness, with a hearing switching judges midstream instead of being ended and then starting with a new judge on some later date.

Witnesses report Smith says I got a gun, Hayes said I got a gun too.. Then gunshots. Could Hayes have just grabbed his gun quicker from his vehicle faster than Smith grabbed his? Definitely possible and its not necessarily damning .

It's all about leverage. Today was not the day for trial, it was only to establish probable cause to keep Hayes in custody, either by a judge's finding in the preliminary hearing (which started) or by a grand jury indicting him (which happened during the hearing).

The indictment should be enough to end the hearing because probable cause has been established. But if John Fuller can somehow get testimony to continue, he learns more and more about what evidence the state has. Prosecutors, on the other hand, don't want to show their cards at this early stage, because that gives Fuller more time to react and prepare a defense for trial. The state eventually is required to turn over its evidence at a later discovery hearing, but disclosure of witnesses/evidence today only helps Fuller.

Keep in mind, there will be several hearings to come for evidence discovery and motions filed by the defense to suppress statements and challenge admissibility of certain evidence. The actual murder trial of Cardell Hayes is probably 18-24 months away.

Well according to your same witnesses it was right after

And the longer the wait, the worst it will be for Hayes. Going to your car then returning to shoot someone in the back would be an absolutely horrible defense. Emerging from his car with a weapon would be a pretty aggressive position to defend

so the interesting thing to me is that he's actually charged with 3 counts of attempted 2nd degree murder

assuming 1 each for Racquel and the other 2 passengers in Will's "G-Wagon"
