The law states they can sell up to 10% of their production at the brewery, so how else do you sell beer without "acting like a retailer"?

I tend to wonder how much of a push the distributors and their lobbyists are placing on this situation, im sure they're pissed they are missing their cut.

I don't think this is coming from distributors... they still get to be the middle man for 90% or more of the in-state beer (minus brewpubs) and 100% of anything from outside of Louisiana, and that hasn't changed in several years. Plus the restrictions on how they can and can't distribute their allotments can't be something that makes them happy.

C'mon guys, the ATC is just protecting your freedoms. Much the same way these guys did.

The root of a lot of these current issues starts with some retailers or trade groups of retailers complaining to the ATC that brewers are "acting too much like retailers" and essentially taking their business.

So the vibrancy of an industry is the only reason my business exists, but heavens to Betsy, I don't want them to get too vibrant.

Dont think I have been back in there since Polly sold me sour BCBS as "the way they intended it to be"

She should be stripped of her retail license. Especially if GI refunded her money and she still sold it.

At least the bartender when I was there admitted it was a fricked up batch, while still trying to pawn it off anyway (at the listed price, of course) as an "interesting sour variation."

Still open, no changes to standard business hours, just can't directly promote any special events.

Gotta go through a distributor. It's been that way since prohibition because of abuse to the system. 3 tier system has its flaws, but it pays my bills

This sentence doesn't make sense, you realize?

I'm all good with you putting food on the table however you need to do so, I'm just saying.

Yes I worded it poorly

Producers were basically unchecked so the 3 tier system was put in so you couldn't be the producer, distributor, and retailer. I guess it was right at the time, but currently it just helps the big guys and hurts the people trying to break into the market, like this thread is about.

I think so, but most of the growing brands sell distribution rights. I sell some local Texas wines and brands like community and deep ellum are with Ben e Keith I believe as well as selling at the brewery.

If followed properly the three-tier system does serve a purpose in preventing the big breweries from strong-arming smaller retailers into only carrying their products. The point was to prevent tied houses like you see in Ireland, where each little pub is only going to carry one group of beer. You'll see all Guinness products (owned by Diageo), or all Heineken International products, never both.

Is a beer release a special event? Say they put smiling ivan over cocao nibs.

That's the wording I was looking for

As far as your first point, that still happens, it's just paid for/negotiated instead of bullied. Theyll fight for the ability to create and revamp the wine sets in stores to where more of their product is there. Or buy nice wine racks for them with the stipulation that only their product can fill it.

The end result is the same in a lot of cases, they only changed the means.

That's perfectly legit. They did Ivan over cocoa nibs last Friday in fact.

Saying that Specific Local Restaurant will be serving BBQ on Thursday, or that a band called Insert Band Name Here will be playing Sunday night, or that Local Yoga Company will be hosting yoga next Wednesday... not cool. That's acting too much like a retailer.

Sure, except now the distributors are doing it, not the breweries.
