But this doesn't require 5 cops and arresting the guy. I say that regardless of how the arrest plays out. These cops should have higher priorities. All these cops when 1 could have fined him. The rest could have been used stopping real serious crimes.

No deadly intent by the law but it ends up in a bad way. Bottom line, do what you're told to do by the law and live to see another day in order to go to court with your beef. A court of justice on the streets will almost always end up in a guilty verdict by those administering the justice on the streets.

This isn't about if the cops had a legitimate reason to be there due to his transgressions. The cops are puppets used to generate revenue. They didn't make the laws.
This is about public policy and the ridiculousness of using finite resources to arrest people who sell untaxed cigarettes on an NYC street corner.

Great point. Not only are the police in this situation to stupid to not let things get out of control. One of the officers uses a banned practice that contributes to a mans death.

Are ordinary citizens prosecuted for homicides in cases where the actions they performed would not be reasonably likely to kill someone?
