Seriously, I'm having trouble keeping up with what it is that troubles you about my position OR, for that matter, what your position may be.

Please, one more time for the slow guy ( ), state clearly your argument relative to gay marriage not being illegal and your argument regarding rights.

I can only deduce that you mean it is not illegal for the ceremony to be performed, but that the ceremony, not being recognized by the state, doesn't guarantee "rights" or privileges that flow from a heterosexual marriage. But maybe I'm off. Please help.

You want me to explain why something that carries with it no civil or criminal punishment whatsoever is not illegal?

So once again, this misses the point. The disparate treatment of the two classes of couples is where the issue of rights comes in. If, eventually, the court decides there is no rational basis for the separate treatment of the two classes . . . well there you have it.

So you're saying the court might decide government has no right to set differential tax policy, and based on that you assert gay marriage is a "right"?

In that vein, I guess "if eventually the court decides there is no rational basis to" limit abortion in a way excluding post-birth abortion, one might currently claim post-birth abortion is currentlya woman's right?

My point is that many of the people I see who are up in arms that the institution of marriage is about to be compromised do not acknowledge that it already has been, and they themselves are at least partially responsible for that.

No doubt. Us heterosexuals have done a poor job of displaying the sanctity of marriage.

Libertarians are losers with that argument because they fall back to, "well since they are in the marriage business expand it to include gays"

Libertarians want gov't expansion in this case. Period. Hypocrites.
