Maybe I'm worrying about nothing, but I'm concerned about this guy reporting the phone lost/stolen and me ending up with a blocked IMEI.

The guy selling it used his upgrade to get it, only opened it at the store to activate it and hasn't used it since. Said that he upgraded just to sell the new device and had no intention of using it.

I started reading up after I ordered and learned that a common scam is to use an upgrade to get a new phone, purchase insurance, and report it stolen a few weeks later. The scammer gets a new phone and the buyer gets an expensive brick.

Is there a way to protect myself? My plan was to use a sim adapter and just switch between my iphone 5S and the G3. I wasn't planning to take it to the AT&T store but should I do this?

I'm really clueless about this as this is my first time buying a phone second hand. Kinda wishing I could cancel but the phone is already shipped. Thanks all.

Call him back, set up a meeting between you, him, and a notary with a bill of sale.

Actually, his thread and the unlock thread got me thinking about this.

1. did the OP mention paypal?
2. this is an ebay purchase, wouldn't he work with ebay on resolution?
3. my issue was a digital purchase dispute with paypal and had nothing whatsoever to do with ebay.

Can't. He's in Massachusetts and I'm in GA. And he shipped this AM.

Wondering if I should just turn around and resell it on eBay

That's the thing. Nothing has happened yet. What I'm afraid of is I get the phone, give positive feedback and a few weeks from now the phone stops working due to bad IMEI because he decided to get an insurance payday or walk away from his carrier contract.

ETA: Maybe I'm just being paranoid.

How long has he been an eBay member and what is his rating?

Member since 1999. 100% positive (81)

Actually...he's almost a mirror image of myself, except he's been around a couple more years. He seems legit. Am I just freaking out over nothing?

Yes. Don't give him feedback until you've had it for a few weeks

Thanks

I feel kind of silly worrying about this. I know millions of used phones get sold all the time with no issue.

Pay with a credit card and be comforted by the power of the chargeback.

If you payed with paypal, i wouldnt sweat over it.

Call paypal (best way) and tell them that the phone you purchased off ebay is reported lost/stolen/IMEI blacklisted. Call ebay and file a claim too.

They will get in contact with the seller via EBAY MESSAGES about the issue. If the seller agrees (he has to) a return/refund, send it back with a TRACKING NUMBER AND INSURANCE. I would even send it back as certified mail w/signature.

Once paypal/ebay sees that the item has been returned they will refund you your money. Make sure all contact with the seller is through ebay messages b/c ebay and paypal can read the messages (to cover your but).

ebay started this new thing that if you are a seller that you HAVE to add a credit card to your seller profile for claims/returns. Im selling something right now on ebay and i had to add my card.

worst case scenario: if you file a claim and he doesn't respond at all, then you win. Money back.

That definitely puts my mind at ease. I did go through paypal so I can file a claim through both.

It's kind of funny, I've always hated how eBay always seems to favor buyers over sellers. Now that I'm a buyer I can finally benefit from that!
