my family had some tax questions and tried to talk to somebody in lafayette and they referred them back to your old firm

Yeah...a good tax lawyer can get very pricey. $450 is not all that much in that world. Four or five semesters of tax classes does not make an expert. Your experience likely trumps whatever expertise they think they picked up.

And if you don't like to discuss tax law at 11pm...you aren't nerdy enough to be in the tax lawyer club. Didn't realize it wa you he was talking about. From my recollection. You knew/know your tax stuff pretty well.

i didn't tell the family i could represent the corporation b/c i took 4 semesters of tax law in law school

oh all i did was point out the tax treatment of health care plans. tax 1 stuff

and i wasn't good in class but Kalinka (RIP) loved me

i did crush tax policy b/c i gave a presentation and didn't have to pay attention

$450 an hour in Iowa is a lot for an average Joe like myself. He's a friend. I'm guessing he charges a lot more than that. He sets up captive insurance companies in the Cayman Islands, Bermuda etc. One for the second largest long haul trucking firm in the country. I play in that arena as well. Reinsurance. I participate in some London programs as part of a group as an investment. Fascinating stuff to me. Been to DC with him. Sat next to him while he testified to Congress. Tax treatment of captives.

I'm guessing between he and I we have it figured out with respect to the employee being treated unfairly in taxation of health insurance.

He can sue her for whatever he wants. Doesn't mean he will win.

There are several factors here, including:

1. Bannon is a public figure. He has to prove that the statement was made with an intent to cause him damage.

2. There are various immunities which apply to elected officials in discussing policy issues.

3. Anti-SLAPP (strategic lawsuit against public participation) laws may provide for dismissal on First Amendment grounds and an award of attorney fees to Pelosi before the first deposition can be taken. And

4. truth is a defense to defamation.

I don't know what the other PT shysters have said but here's my quick take:

He is a public figure. He would have to prove actual malice. Pelosi's defense is that she was merely expressing an opinion on a matter of public interest, and "white supremacist" is a mere pejorative or vulgar abuse, like calling him an a-hole, which is also a defense.

In Texas, calling someone an illiterate, backrupt, homosexual, communist [together or separately] is considered per-se defamation if the statement is false. In other words, you don't have to prove that those statements are defamatory. Those words are defamatory as a matter of law (not fact).

With the truth on my side, I routinely call them commies.

i don't know if it's been said, but in addition to being a public figure, that's likely going to be defended as political speech, which is our most protected form of speech.

I think those guys use him as outside counsel. I'm not sure about that however. He was a sole practitioner. There was a firm of sole practitioners. He was the only one left. One got appointed to the Iowa Supreme Court. He got caught up in the gay marriage thing here. We basically unelected the entire Supreme Court. Two others are District Judges. So he went to an old money country club firm. After the first year they figured out he was the largest billing attorney in the office. It was a strange deal. The first year he was at the new firm I show up to talk to him about my taxes. It gets cold up here in the winter, so I'm in a corduroy sports coat, mock turtleneck and blue jeans. I wear stuff like this in front of judges and elected people, I didn't think there would be an issue with my dress at a place that I was writing a check to. They all look at me. You could see their contempt, every attorney in that place had this practice and wealth handed down to them.

So we go another year. During hte year something happened. The Iowa Supreme Court had a ruling about tortfeasors. I'm on the board on my industry PAC. Long story made short, we overturned the Supreme Court legislatively, and against the wishes (and lobbying) of the Iowa trial bar. So I walk in their office to talk about my personal taxes. Look, I don't dress up for anyone, but I don't make it a point to try to offend anyone, so I dress up. I didn't need to. All of them were like welcome sir. How are you sir. I don't care, and they're good guys, but that third generation hand me down law practice old money country club crowd is one group of fake people. They're just no that smart. When the Governor signed the bill, I was there. To this day they have no idea I was involved. The only reason they treated me well is they had a year to see how much my attorney billed.

And to correct the record, it might not have been the other attorney on here that indicated the employees were being treated unfairly. I'm not sure how anyone could come to the conclusion an untaxed dollar of benefit is not fair compared to the employer who has to spend money, so he can make less money, so he an pay less in tax. It might have been the economist that suggested this.

Anyway, that's probably way too much information. Someone could put two and two together and stalk me, so I'm out.

Uh no. I love how offended you guys get when you see someone doesn't agree with your brain dead point of views.

He will never sue. He won't even threaten to sue because she would embarrass him when she calls his bluff and he flinches.

You're my favorite kind then ... we're having a good time, you're laughing at my good ole boy guips while looking for a gotcha opening ... then all of the sudden you hear the other attorneys at the table laughing and the stenographer asks me to repeat something because she was laughing and lost her place ... so I ask her to read back to where she lost me ...

... and then you go hostile with something like, "but are you an expert at this or that" ... and then I know I've got you.
