Once they hit U.S soil, they're guaranteed full constitutional protections.

During WWII German soldiers were held in prisons in the middle of the U.S. and not only were they treated well, but Americans who had husbands and sons who were fighting them would show kindness to the Germans in nearby POW camps.

Now the people of this country rather than demonstrating fidelity to the concept of rule of law and the Golden Rule, choose to treat people caputured in an undeclared (and therefore unconstitutional and so illegal) war in a way inconsistent not only with the treaties we have signed, but inconsistent with the way we demand other countries treat Americans captured when fighting on their soil and inconsistent with the basic human decency that at one time we stood for. The whole "illegal combatant" garbage is something made up from thin air during the Bush administration, and making legalistic sommersaults to justify this is the only refuge of those who know that they have no moral justification for their postion.

Not only is it a reflection of weakness, it is reflection of the utter gutless cowardice on the part of many who call themselves Americans which has been so clearly on display since 2001.

Added to this is the hypocracy of many on the right who like to scream about their love of the Constitution and the ideals upon which the country was founded, the hypocracy of many on the left who critized this policy when Bush instituted it but ignore it under Obama, and worst of all, the hypocracy of those who call themselves Christians while supporting the indefinite imprisonment and torture of people who have, at most, committed the "crime" of fighting an invading army. Again we treated German pow's who no-one disputed had killed American soldiers, much better.

They were never put in Guantanamo because they were some how "too dangerous" to be held in the U.S., it was conceived as way of allowing the president to act outside the law, and the very same people who are correctly outraged at Obama for acting outside the law, were the ones who were fine with Bush setting the stage.

Those afraid of bringing them here either for trial or proper imprisonment as pow's would have us beleive that they are some sort of uber criminals from Krypton who need to be cast into the phantom zone because they have superpowers and would kill us all -- Cowards.

I remember that flaming a-hole going on and on about how signing statements were George Bush's way of doing an "end-run" around congress, and how he'd stop the practice if he were elected president.

1) I haven't seen any evidence to suggest that German soldiers were any more conscripted than American soldiers. Most Germans thought that fighting for the homeland was the patriotic thing to do.

2) Where in the concept of rule of law, or in the commandment of Christ to apply the Golden rule to everyone does one get except "fill in the blank"?

3) What is a "terrorist"? Is some guy who picks up a gun to shoot at a soldier from a foreign army who is killing his friends and neighbors a terrorist just because he doesn't have a government issued uniform? If so that applies to men and boys who turned out to shoot at the British regulars as they marched back to Boston after the action at Lexington and Concord. Were those who defended the alamo terrorists also?

3a) The people who flew the planes that crashed into the World Trade Center were from Saudi Arabia. I don't remember any military action or sanctions against the Saudi's.

3b) Were the Afghan "freedom fighters" fighting soviet occupation with support from Regan and with popular support from the people of this country as reflected in "Rambo II" terrorists?

Thought you didn't believe in Jesus? Anyway, for you lawyerites, if tried in civil court these guys will be able to appeal x amount of times? Are appeals widely used in military courts?

The GITMO prisoners for the most part were captured on the battle fields of Iraq and Afghanistan and have no business being tried in a civilian court by anyone or anywhere other than GITMO.

The large majority are not. LINK a lot of them from Yemen. Scroll down and they list them.

Good they deserve a fair trial.

DAFUQ?? They are passing legislation to allow them to detain American citizens without cause for indefinite lengths of time, but trying to afford more and more protections to these shitbags? This shite is getting f$%king surreal. Next, we'll be giving them lawyers at the taxpayer's expense.

Who's paying for Gitmo?

For that matter, who's paying for this whole contrived War on Terror?
Who's paying for the elite to profit TRILLIONS on the poppies, pipeline and natural resources in Afghanistan?
Who's paying for the elite to profit another fortune by propping up the Petro Dollar in Iraq?

This shite got f$%king surreal a long time ago!

Seems like the plan is to make it easier to transfer or release the prisoners altogether. Why house and try these terrorist criminals when we can just drone them?

The amount of complete liberal-think (I am being kind) in this thread is astounding.

Anybody ever hear of military tribunals? Any of the posters in this thread care to look up how much money was spent building an expensive courthouse in GTMO so the poor, poor terrorists had AC for their trials and sentencing? Obama has released many terrorists from GTMO and guess what? After the terrorists promised they would be good, (remember that news?) they returned to training camp in Yemen and where ever else these terrorists train at this date and time.

Obama is trying to appeal to his base which is most of the replies in this thread. This has been discussed before and it was shot down. Remember Obama and his cronies were going to build these terrorists a special prison in Chicago? It is up to a military tribunal to give these people life sentences or let them free. Obama usurps this.

The comments in this thread as if these poo,r poor accused terrorists have suffered with a fricking million dollar soccer field are despicable.

The only detainees at GTMO are proven in tribunals to be terrorists. No matter what their pathetic attempts to starve themselves for attention- activist spokespeople say. How many of you would be shocked if the remaining terrorists at GTMO were ordered to be moved to the prison near your home and then given a new civilian trial and somehow let out on a technicality? Or pardoned by Obama on his way out?

Little of the evidence we have would stand up in a civilian court. The chain of custody, the civilian standards of evidence, Miranda rights, no one was paying attention to that in Afghanistan. For that reason it would be very difficult if not impossible to try the detainees in a civilian court.

Exactamundo. But Obama wants to try to get his poll numbers back up appealing to stupid, progressive- think, tree hugging. jackasses. AKA the 'intellectual' progressives.

The old mantra, the world looks at us badly because of GTMO is moot and ridiculous. The "world" already thinks Obama is an idiot.

Im all for bringing the little bad arse terrorists to the US. In fact, I got a plan just for that. Briong em all to La. and put them in the "general" population at Angola. Without a gun, bomb or airplane, those Snidely Whiplash little bastards wouldn't last ONE day. End Problem.

Maybe, but only so he couldn't claim "religious persecution" while some North Shreveport Gang member is slitting his throat from ear to ear. Akbar Allah
