She had to share it.

I have no doubt that she had the higher GPA and should have been the sole valedictorian.

This is not a lawsuit.

It's an award.

A political and often phony award.

It's not a suit upon which relief can be granted.

That's like Favre suing because he didn't win AP MVP.

It's not all GPA...they changed that years ago. It's a "myriad of accomplishments" to include others who wouldn't normally qualify.

Once you open Pandora's box, Pandora comes back.

I don't have an opinion on that. However, I did attend a High school awards ceremony this year and noticed the following. Every single white student that was awarded a college scholarship had a AP or Honors Stole. There were 13 African American students that were awarded scholarships and exactly 1 of them graduated with honors.
That was just my personal observation at a single awards ceremony and it had no bearing on anything.

While this may seem like an issue of just producing grades, it is not.

School's have much subjectivity in granting these types of awards.

Regardless, as has already been pointed out, the girl had no damages. She was named valedictorian. Whether she had to share it or not is meaningless.

Why? The school says they tied. The mom says otherwise. How does the school end this if they tied as they say.

Yes. But what the bias is isn't apparent.

Let's face a few things:
1) Anyone suing over co-valedictorian status is a chump.
2) The mom is basing her lawsuit on secondhand gossip about another kid's GPA.
