You're main area of practice is in state comp/LHWCA? How long? NOLA, BR, where? May have run across you before. I'm not an attorney, but investigate & make the compensability decisions for a WC carrier in La. If we've never met, we definitely know some of the same folks I'm sure.
ETA: reread a post and see you've been at it 28 years. That's the majority of my life (I'm 39), but my point still stands.

I'm calling bullshite! Ambulance was there which means cops were there which means either it was a hit and run, or the police made a report. No way they go there and let everyone drive off with a totalled bike on the scene.

I was in a slightly bad accident in college. Broken jaw, broken teeth, road rash everywhere, spent the night in a neck brace as they wanted to be sure I didn't break my neck. I was hurting for over a year and still get some drop you to your knees pain in my jaw 7 years later. Never planned to sue.
They sent an adjuster to my house to speak with me. Very nice lady. I'm pretty sure she saw me all banged up and with my mouth wired shut and they knew it was serious, because they took her off the case and replaced her with the biggest prick ever. I was ready to get my bills and everything covered and the guy asked me for a number, so I started digging into case law online for settlements with similar injuries and hospital bills. I know I'm not a lawyer, but if you are going to ask me what the number is, I'm not just going to make something up. This guy proceeded to take everything I told him and make it seem like my injuries weren't as severe. I sent pictures of scaring on my face and he would tell me he didn't see anything. He literally would not cooperate at all. He basically would cover my hospital bills, when we knew I still needed extensive dental work and there was a very good chance I had another jaw surgery (ended up just needing a lot more dental work than originally expected). So I eventually got a lawyer. Even my lawyer hated working with the guy and apparently got in several arguments with him.
Now, it does feel sleezy when you go through the lawyer process. They definitely send you to "their" doctors and chiropractors so that you continue to be "under a doctors care" to make your injuries more "real". But at the same time, I've seen what insurance companies are like when they realize they're about to have to pay out.

Don't feel bad. A woman of color ran a stop sign the day my roommate was supposed to move in. He was going 60. She spun him around so much that he also got hit a second time on his drivers side by oncoming traffic. She had no insurance. He went to the hospital. Ended up getting paid and a new car. Titties.

Who "paid" if she had no insurance?

Want to know a disheartening fact... Defense guys have "their" doctors, too.

You should not feel bad about the situation you described. You were owed compensation from that shitty driver.

All depends on what the motto of the insurance company. Some choose to pay claims and avoid litigation costs while other deem litigation cheaper than claims. Hard for a lot of health/auto because of the potential downside risk of large claims. Straight "milking" of insurance companies and "not worryings since insurance pays for it" though is what causes them to be more litigious and not pay claims well.
If I had a case though, I would have no problem suing for damages if I felt my claimed damages were real and their insurance adjuster didn't get it right. It isn't a money grab but an effort to make you whole when another party damages you.

I have a family member dealing with U.S. Agencies, and I swear, don't know how they don't get shut down by the Insurance Commissioner

Affirmative Insurance owns U.S. Agencies. Companies like that one are who give the entire insurance industry as a whole a bad reputation. U.S. Agencies is a truly shitty and unethical company. frick them up the arse on a sandy beach without a condom with a bloody, AIDS dick then wash up in rubbing alcohol. frick em all the way to the moon and back. frick them frick them frick them frick THEM!
I'm a little bitter toward that company.
As an added bonus to prove how fricking stupid they are, their GENERAL MANAGER OF AGENCIES tried convincing me that Comprehensive coverage is what covers the other guy's damage when you rear-end someone. I sat and argued with him, trying to tell him that's your liability coverage that covers the other person and he insisted that it's YOUR comprehensive coverage that covers the OTHER GUY'S damages when YOU rear-end them.
That company is fricking pathetic.

Link? I'd love to use that at least a few times a week.

Unfortunately the link is my head. He told me that one-on one while I was in training to work there. That comment alone is what resulted in me going back to my hotel that evening and buying a flight on my own back to BTR. I quit the job. No way was I going to work for a company like that.

Typical. At least you have some ethics. Kudos to you.
I question adjusters' humanity all the time.
