When interviewing for a job, how damaging can misdemeanors from almost a decade ago be? (Non-violent, non-drug arrests.)
Posted on 9/25/14 at 1:38 pm to bhamtbone
I would say that depends on the job.

You want to look up expungements in whatever jurisdiction you're in.

Depends on the job and the offense.
Even with an expunged record, there are still some databases that you will always be in.

Many do, but it depends. In some ways a speeding ticket or a car accident can be as bad or worse than a misdemeanor. It just all depends.

You can't expunge a conviction or guilty plea.

Depends on the conviction in LA.

Seven years is a good rule of thumb.

Contact a lawyer. It can be done.

If you plead guilty or take plea deals or any conviction then expungements do not apply.

News to me. But I haven't done any real criminal work in years. What convictions can be expunged?

You can expunge an arrest record for certain misdemeanor convictions in LA.
Unless I'm reading it wrong.

La. RS 44:9(A)(5)(a): Any person who has been convicted for the violation of a municipal or parish ordinance, a traffic violation, or for violation of a state statute which is classified as a misdemeanor may make a written motion to the district, parish, or city court in which the violation was prosecuted or to the district court located in the parish in which he was arrested, for expungement of the arrest record if five or more years has elapsed between the date of the motion and the successful completion of any sentence, deferred adjudication, or period of probation or parole. Notwithstanding the provisions of Code of Criminal Procedure Article 892.1 or 894, or any other provision of law to the contrary regarding the set aside of a conviction or the dismissal of a prosecution, an expungement shall occur only once with respect to any person during a five-year period, except in the case of a misdemeanor offense of operating a vehicle while intoxicated which may occur only once with respect to any person during a ten-year period.
La. RS 44:9(A)(5)(b): No person shall be entitled to an expungement if the misdemeanor conviction arose from circumstances involving a sexual act or act of domestic violence.
