38,000 doctors should go to prison tomorrow

quote:

The Anti-Kickback Act of 1986 prohibits government contractors and subcontractors from issuing or accepting kickbacks. If a contractor or subcontractor forces an employee to kick back part of his or her compensation, the contractor may face a $5000 fine and/or five years in prison.

dinner for three at a high-end Washington restaurant last summer totaled $2,016, or $672 per person, and included a $1,000 honorarium to the speaker. One of the two attendees attended the same program a short time earlier, the Justice Department said. A 2006 dinner for two at a West Des Moines, Iowa, restaurant topped $3,000.

quote:

"In many instances Novartis made payments to doctors for purported speaker programs that either did not occur at all or that had few or no attendees, and thousands of programs were held all over the country at which few or no slides were shown and the doctors who participated spent little or no time discussing the drug at issue," the release went on to say.

quote:

The Justice Department filed a lawsuit in federal court against the U.S. division of Novartis, saying the drug company violated the federal Anti-Kickback Statute from January 2001 to at least November 2011.

quote:

Novartis spent nearly $65 million on more than 38,000 speaker programs in a nearly 10-year period, the government said.

frick em all...and just like drug dealers.... confiscate their corvettes and houses with all the illegal money that they got.

It's like a smaller version of our federal government and Obama legislation.

you know, great idea.

5 years in prison, or 5 years community service treating patients for discounted prices.

When we discussed a similar topic on drug reps a while back, it was pointed out that a lot of this stuff got scaled back big time, but it got me to wondering what the statute of limitations on that shite is.

if some school board member was getting kick back to decide to use a textbook that costs $100/each versus other on the market that are $15

you would be okay with the grease? why do you people hold medical scum in such high regard?

So the Justice Dept. is arguing that because MD's get Medicare/Medicaid money, they are a government contractor?

Why pick on the medical profession alone. Let's extend this scrutiny to members of congress, those in the oil and gas industry, perks to major college football coaches, and especially whatever industry Kashonly is in.

There, that's a start.

Precisely why I don't accept medicaid patients. When you lie down with dogs, you get fleas.

Bottom line is that it is difficult to make a living in healthcare without accepting government payers. Accepting government payers subjects a provider to both Anti Kickback and Stark.

Compliance to these statutes is mandatory and penalties are stiff. If you accept government money, you play by their rules or prosecution is a very real possibility. Definitely not worth it to push the boundaries.

Not that I blame you as I wouldn't take them either, but does that somehow violate the Hippocratic oath? Seems like you would be treading a fine line.

Nope. Hippocratic oath only applies after you show your health insurance card. No free loaders.

if you really believe this, you should stop going to your doctor. If you think s/he's a criminal, why would you trust them?

I suspect, this a great example of Internet Bravado. I'd wager a handsome sum you'd never tell your doc "you should go to jail" to his face right before he was to perform a procedure on you.

Doctors aren't as ethical as they say they are.

They want money just as bad as anyone else.

Maybe it is for the knowledge and skills they have acquired through years of dedicated study?

Actually, the Hippocratic Oath went out the window when Roe v Wade was implemented.
