Getting screwed by ex wife Tax Question?

I have gotten fricked this tax season. I have 3 children and my ex claimed all 3 three this year. She wasnt allowed the last 2 (divorced 3 years) because oldest lived with me because she moved out of state. Make long story short she moved back beginning last year and son lived with her whole year. I pay over 20k child support and all medical and dental on all 3 kids. I offered to pay the difference for the second and third child so i could claim one child. She said frick you i am claiming all 3 now i am stuck claiming single no dependents. It is about 4k out of my pocket now. Am i fricked and yes i am going back to court to try and claim one chiid for the upcoming years. Sorry so long

This shite wasn't drawn up in the divorce papers?

My wife and her ex have all that detailed out so there are no questions. Sounds like you might need to go to court.

Was clueless when went mediation. Now i understand would have been like 600.00 dollars extra for her by claiming 3rd child but for me i have to pay additional 4k. I get it i was trying to be social with her and tell her i would pay her the 600.00 so i could claim the 3rd child but like others have told me i have to threat this like a business. I get it now i understand thats why i am going back to court. Bitches be crazy and me just being stupid.

If its not in writing, claim them first and tell her to frick off.

Original copy said she could claim all 3 but right after mediation she moved with two youngest and oldest stayed with me. I claimed him last two years now my complaint now is i paid her the 20 k and now i will get taxed on it too. I wanted to see if i could claim something on my taxes that would help me?

I forgot about the oldest staying with you.

That's just a shitty situation man. I'm no tax expert so I don't know if there's anything you can do. Good luck

So you have 1 living with you and pay child support on the other 2. Does she 'pay' you on the one with you.

I would assume if that is the case.

I paid her full child support for all three even when my oldest stayed with me. Just so i could see my othet two. She even trying claiming all 3 last year on taxes but wasnt allowed be cause i told her he was living with me.

To the poster that said i was shitty to her. Wrong even her family took my side because she cheated on me. Has gone out of her way to frick me over after the divorce also.

2.) Send all child support checks from account drawn in new LLC's name.
3.) Force Mom to cash checks at her bank using LLC.

5.) Profit (schadenfreude)

Do your taxes now, claim which kids you want to claim, and the IRS will deny the last to file/claim.

Then she will have to negotiate with you when she is enlightened on what she will spend hiring a lawyer when you take her back to court!!

AND, she won't have the refund in her pocket while this debate is going on.

DO NOT PLAY NICE, YOU WILL LOSE!!!!

I fought and I won! She let's me claim our daughter because the private school increase over the years is $300/mnth which I would use against her IF she were dumb enough to take me to court over claiming my daughter.

I pay the extra school $ and she stays quiet...I think I still come out behind, but court is expensive.

Doesn't work exactly like that. His ex has legal papers that state she gets to claim them. He can file whenever he wants. All she has to do after that is send in her return with a copy of the legal papers and she will get to claim them. They will then go after him to recoup the money. Just because you claim first doesn't mean you get to legally claim them. If their are no legal papers, then it goes off of who supports the child the most. Just because you pay child support doesn't mean you support them the most.

You get this. We did this when she had no job. I had no clue can they change the intial mediation papers about the tax part. Hell i have my kids alot more then the paper states can document and will the state not ask why i was able to claim him the last two years even though paperwork she could claim all three. Also i can show doing those years he was living with me i was still paying her child support for him. I dont understand that the irs wants us to claim everything and right on my paycheck its states it goes to child support and i cannot claim at least one chlld.

Support is funny. Say you pay 20k in child support. They will also take into account her support. She provides a house, electricity, food, and all other stuff. This all adds up. Just $1k mortgage/rent and $500 in food is $18k. This doesn't count other household bills she has. Majority of the time, if there are no legal papers stating who claims, if the child is with one parent for over 6 months in the year that parent will get to claim. Now, to prove this, they will want school records and such. If you can't prove to the IRS that the chaild lived with you for more than 6 months, it will be a lost cause. I know this because my ex claimed our son first. When I filed with e-file, it got kicked back because the ss number for my son was used all ready. We did not have anything stating who gets to claim. I had to send in his school records and our custody agreement(I am the domicile parent for the school months, her for the summer). I got my money in December with interest and she had to repay.
Since there is a legal agreement, you would have to get that changed.

The State or Fed Govt doesn't care about this. They look at it like she did a good deed for you.

It can be scary. My first wife cheated on me after 17 years and 2 kids. (I was faithful) and I divorced her immediately and reported her transgression to HR as retaliation. She showed up with a gun with intent to kill me because I ruined her married boyfriend's chance of a promotion (as if he was going to divorce his wife).
