I do a little work on the coast and have had a couple of folks ask me if I've filed a claim with BP yet. It sounds like there is quite a bit of "stretching the truth" going on with these claims. I could probably fabricate a reasonable story, but it would certainly be a fabrication, therefore I'm not planning on submitting anything. Anyone on here filed a claim?

I know some people who filed claims. Most have gotten or are getting money under the settlement. Consult an attorney or a knowledgeable accountant to see if you have any losses that are recoverable under the settlement. What is your business?

BP claim is a once in a lifetime plaintiff's attorney case. They are just printing money for themselves.

Under the settlement agreement that BP approved, claimants are not required to prove that their businesses were damaged by the spill.

This But it can be difficult to prove causation if you are in Zone D. Just depends on where the biz is located.

A good friend of mine works for one of the few accounting firms which analyzes the claims. I would strongly advise you to refrain from doing this sort of thing. The firms that are analyzing the claims take this sort of thing seriously. While there are stories like X business got Y payout for nothing, they are usually within a heavily affected region, or it is a business directly tied to a heavily affected industry (tourism, seafood, etc.) where little to no causality must be proven. I would err on the side of caution.

Use an accountant, not an attorney to prepare your claim. Most accountants are not taking a contingency fee, while most attorneys are taking at least 15% of an award. As far as the moral stance on a claim, that is obviously up to the individual. I would feel a little funny taking money I didn't feel I deserved, but you could always take it from the Brits and do something good with it. Church, hospital etc.

You do not have to show proof of loss. Consult with an attorney or CPA regardless. The structure of the deal, as I am aware, lets you compare months over several years and certain months during the spill. If some were higher than others by any chance, you can file. This could be done if you are in a service industry during the holiday season, or a bar during mardis gras.

Or a farmer...or a metal fabrication company...or so many other segments of the economy with erratic income streams. I predict that by the time the program concludes, BP will have sued the experts that advised it on the terms and breadth of the settlement .

I filed. Got paid a portion of my loss in nov of 2010. Still waiting on the remaining portion. They made me an offer last March but they used some BS criteria to formulate the offer. I filed again with Deepwater Horizon Claims Center and am waiting on their offer. This whole prices has been beyond frustrating. I have been asked for some of the same documents over and over even though I handed it in and and have gotten the run around a lot. By the way, I was in seafood. Wholesale to other restaurants/markets and also seperate Retail/restaurant business actually. I am also an accountant (undergrad in accounting and masters in finance) so I did my own claim.
