Best way to handle a poacher I have seen yet from another board I lurk on. Still waiting for the payoff should be good.

So my brothers pull up to my property to do a little scouting & there's a local truck parked about 100 yards deep. I'm currently in the air force in las Vegas & my brothers are army at Bragg, a good 2 hours plus away, so the locals trespass like there's no tomorrow. The land is unimproved & there's really nothing we can do until I move home in 2 years so we just grit our teeth & bear it.

They call me & ask what I want to do...call the GW (btw) this is day before bow season & the guy is bow hunting), can't make it for a few hours. Call a local deputy & he comes quick. They head down on the farm & see the guy & he skedaddles off onto some other property & they lose him.
What to do? The deputy gives some good advice.

We called a tow truck, had the truck towed to my dad's house. Then we sent in the correct forms to the NC DMV license & theft bureau. Now the owner has 30 days from the date of the certified letter (which arrived today) to come claim his very nice 4x4 05 f150 crew cab & pay towing fees as well as storage fees ($20 a day!) or at the end of 30 days the truck will be sold to cover costs...

Oh yeah, here's the kicker. If & when the guy comes to claim his truck the sheriff is standing by to arrest him for trespassing since both his deputy & one of my brothers saw the guy. Plus, the GW wants to chat as well. So! I may have a new truck or at the very least this guy will be looking at a little trouble. Hee! Hee!

thats awesome, would have to check out the laws in MS to see if that would fly, but if it does, i may have a new plan of attack!

Here is the only real update of substance so far

quote:

He was definitely poaching. Both my bro & the deputy saw him bow in hand, full camo, walking back to the truck about 11:15 am. Unfortunately they both entered the same field about 250 yards apart & saw each other about the same time, hence why he was able to allude them. Also his bow case & - get this - cell phone are still locked in the truck along with scent killer spray, etc. Enough for the game warden to get him for hunting out of season when you get the 2 eyewitness accounts to go along. The funny thing is that my brother told me the phone was ringing off the hook for the next day. The truck is locked & we've been legally advised we can't have it opened until we get title awarded (if we do).

It may be a moot point bc - no surprise here - when they ran tags & vin # the owner of record has outstanding warrants for back child support & failure to appear. Anyway you cut it, this guys not having a good day!

I'm having fun with this one. You don't know how many pictures we have of poachers or just jacklegs joy riding my place.

That's funny and all, but no way in hell I mess with the truck. If I do, I make sure it's not towed to private property I'm connected to.

If that is all 100% legal then that is badass.

I would be somewhat worried about a guy who doesn't pay child support, hunts out of season, and poaches, knowing where I live. Especially if I'm fricking him over that hard (even though he deserved it).

Would've been better if it was towed to a police impoundment and then they could still get him with the charges.

The guy is gonna have to figure out where the truck was towed to. Only way to really do that if he isnt familiar with the land owners it to call wrecker services in the area or the police. Pretty good idea and I will def start suggesting this to others.

He posted this the other day as well in response to someone saying the perp may be reading the thread so it sounds like he knows who it was...Really looking forward to a conclusion this is some awesome stuff.

quote:

Ok, in the off chance that you are reading this sir, here's my appeal to you. Please give me a call. You have my cell phone #. If you don't want to talk - you can even text & I'll give you my email.

You may feel we're foaming at the mouth to confiscate your truck & make your life hell. That's not the case at all. My brothers & I are hard-working military men who only get a few days a year to deer hunt. In fact, one of my brothers left today & won't be back until well after deer season so you see why we take our few chances seriously. The land you trespassed on was my great-great grandfather's, then he sold it & I recently bought it back after 104 years. It's important to us.

Honestly though? if you had simply asked for permission I probably would have given it. The guy I have looking after it now is way over worked & admits he can't stop in enough. I would have probably just asked you maintain a few stands & maybe put in a food plot or two that I would have gladly paid for seed, fert & diesel.
we're not bad guys. You probably know that because I know of you & I know one of your cousins. I doubt you are either, you've obviously made some bad choices though.

Here's what I'm going to do. If you turn yourself in I'll drop the trespassing charges on the condition we get a written apology. I'll also release your truck to you for the towing fee & dmv fees we've paid so far ($110). I can't do anything about the hunting out of season or warrants, you'll have to deal with those, but at least you'll have your truck back.
You obviously love the outdoors. So do I. However, you've been going about it all wrong. All I want is an apology & an attitude change. Yes you'll probably go to jail, or at least get probabtion, but you'll have your truck back. However, if you still want to be mule headed about this I'll take your truck. Simple as that.

Call me dude. Ball's in your court.

The bank would probably have something to say about getting the truck I'm assuming but still awesome nonetheless

Sounds like a good story to follow. This could turn out better than Diesel's Green Jeans/Whop Head Thread.

In reading the thread on page 8 the OP lists all of the info he found out doing research - very inclusive. That guy definitely did his homework!

If this dude ends up with the truck, he wins. hands down.

I hope he does.

this almost sounds too good to be true, like a Penthouse Forum letter. you know "I never used to believe your stories until this happened to me..."

In La towing companies have the right to sell cars on their lots after certain formalities are taken, and the car is not picked up, but not private landowners, unless there is some new statute i have not heard of.

Out of curiosity and complete lack of knowledge on the subject.

What if he reports the truck stolen and says the person that stole the truck must have been the person poaching?

No chance. Are you in law school with this type of hypothetical?

i assume they can compare the time he reported it stolen to the time that the tow truck company picked it up

No Sir! Not a law student.

I was just thinking how screwed this guy is or is going to be and what I would do in the situation. (Not that I ever would be)
