when am I allowed to use/brandish a gun?

A friend of mine was followed by two cars yesterday for a couple of miles. He "lost" them by going fast as hell on some back streets.

After they "lost" the tail. A few minutes later one of the cars pulls up. Jeff (the friend) runs out to the car and points a gun at them.

They drive off scared. Turns out it was teens playing a game with him because he was cut off and then honked his horn.

I told him he could get in trouble for brandishing the gun. He said he could claim defense since they followed him to his home.

IDK if someone followed me to my house I would want to scare them off too.

I told him most likely his tires will be slashed in a few days.

I was always told only point a gun when you plan on using it. He says he thought they had a gun as the passenger was pointing something out the window.






Why weren't police called???


Because on average it takes over an hour for a policeman to show up in NOLA.

For a person carrying a concealed weapon, the only allowable time to use your concealed weapon is when your life or someone else's life around you is in immediate danger.

If someone follows you for a few miles, to your house. While one is pointing something out a window, would that suffice?

Also NO CCP.

Jeff just keeps a .38spl in his car.

He said he had no thoughts about flashing the gun until they pulled up to his house where his family lives. He was shaken up.

I asked if he called the cops he said "I got their plates, if they do anything"

force with force, you cant pull out a gun in this situation. Probably not a good idea to tell this to police.

A couple years ago there was a situation in my condos that resulted in a shotgun being pulled. NOPD did not take the guy in because in their judgment the man "perceived a threat"*, and was justified.

If your friend says he perceived a threat, and no shots were fired, NOPD will probably let it go even if it is reported.

That said, it's not a good idea to pull a weapon until you're really fixing to use it.


* In that situation there was no real threat at all.

to me, if someone follows me to my house, and now knows where I live then they are a threat.

I think he was just scared, but then he said when he saw they were just teens (couldn't tell when driving as windows were tinted dark)
he wished he had just stopped and confronted them.

I get that.

But it should be if you're threatened for your life. I've brandished mine twice, and both times I'm for certain a situation was averted. I'm more prone to do it if my wife or girls are with me than if I'm alone. Can't take any chance with them. You know the old judged by 12 or carried by 6. And I can get a damn good lawyer! And if it's in Union county and most of the surrounding ones, I'm good.

I have a question: There was obviously multiple people since it was two cars. I know that if I am attacked 2 on 1 by I can pull my fire arm. I think that if someone followed you to your house when A)No one reasonably tried to get your attention and B)You took evasive measures that were much outside of your normal route, that you would be able to perceive them as a threat.

I just said "we were bad kids too" I doubt they do anything.


He said the chick in the car said something like "my dad will beat the shite out of you, or do you know who my dad is?"

something like that.

Just a road rage incident really.

Just IMO if someone follows you to your house, that is a threat. And if he really was verbally threatened on top of that?

IDK.

that's what I figured as well. He had to speed twice the speed limit, run three stop sigsn, make two illegal turns and then after all this and losing the car he parked at his house and not a neighbors.

I would have drove to the police station or to a public place or something.


It was two cars a newer green mustang and a newer silver Maxima.

Apparently it was a guy driving the Mustang, with a female passenger. Then two girls in the Maxima. He said the Maxima tried passing him twice on a single lane one way road.

The passenger of the maxima kept pointing something out the window. He couldn't tell if it was her hand or a gun or something.

He didn't get the plates of the Mustang, only the Maxima. Metaire address linked to the plates.

A female is a potential threat too. I definitely think this is a situation where you can pull a firearm.

the car had limo tint all around. He showed me a pic of the car. He couldn't tell who was driving.
He thought he was going to get jacked or something. Once he saw it was two teen girls he kind of laughed about it, but was still shaken up.

He said if he knew it was three girls and a dude he would have got out and confronted him.

But at the time he said he was scared.
I get that.
