You theoretically could say you suspect someone is hiding something in their home, or has broken some wildlife law and just make your way right into their house or car.

Completely false. Unless, as I said you're in the field...i.e. the woods/water/side of the road hunting

ETA: Your home is your home, however if I knock on the door and you open it and theres 15 deer hanging in your living room, you have a problem, but that falls under the plain view doctrine.

Then, why did a game warden come in my grandfather's house and write him a ticket for having more than 16 squirrels in his freezer???

He went to court to fight it and guess what? He lost.

I would imagine he had a warrant, or your grandfather allowed him entry and then a series of questions turned into your grandfather giving the agent reason to believe he had illegal game in the freezer.

People open up way more doors than they think just by saying "yes" to a few simple questions.

well they are federal agents, so yes they do have more power than most other law enforcement...they could even stop you for speeding if they wanted to

No... Theynare not all federal agents

And if you read the fine print on most hunting regs and most notably public land you pretty much agree to searches......

You may be correct about the simple questions. I was not present, but I'm guessing he didn't lie about anything. The whole family had been there squirrel hunting that weekend, and just left the squirrels there in the freezer without tagging them. I'm sure when the GW asked how many he had in the house pow-pow just told him. I know he tried to explain that there were several hunters there for the weekend that had left theirs, but the GW didn't want to hear it.

It happens, some guys are better at the verbal judo than others and have a knack for getting people to admit to something without them ever knowing it. Other times its just people thinking they didnt do anything wrong and just tell the truth and get in a bind.

And.....

The rules of probable cause still apply

In many parishes ldwf cannot enforce trespassing not all parishes give them broad jurisdiction....some parishes do....

Bottom line play by the rules no problems...

As for 16 squirrels in freezer that is not possession limit once it home and dressed and stored it is food....in most cases if they really wanna find aomethingnwrong they can

This, and the GW already had it out for pow-pow. The GW's family owned this tract of land at one time and fell onto hard times. Pow-pow ended up buying it, and the GW had it out for him ever since.

I've argued this point with others before on other websites. Maybe our resident GW will chime in with some clarification.

So much fail in this thread

quote:

Bill OReilly

if you follow game laws then you have no reason to worry. Every sportsman will agree that some laws are bull shite and a pain in the arse to follow. Keeping that in mind, the laws are there for a reason. If you dont agree with something then there are ways top voice your opinion. Getting ticketed, paying a fine, and losing all hunting rights wont get your point across.

I know you can't believe everything you read on the inernet, but this comes from Wikipedia.
From Westlaw:

La. R.S. 56:55(A):

[A]ny commissioned wildlife enforcement agent of the enforcement division may visit, inspect, and examine, with or without search warrant, ... boat, ..., car, conveyance, automobile or other vehicle, ..., or any place of deposit for wild birds, wild quadrupeds, fish, or other aquatic life or any parts thereof whenever there is probable cause to believe that a violation has occurred.

Think about it like this. If a game warden comes to your house then he already has reason to suspect you have something there illegally. Its not like he looks through some mysterious database of everyone that hunts and random picks people to go mess with.

Nit pick or enforce law? I mean, it is the law. They are there to enforce game laws. No matter how big or small. If you are going to have that position than the easiest way to do it is by the book. The fish is or isnt 12 inches, the deer is or isnt tagged, etc. Im not saying it doesnt suck but its the way it goes.

For the record, Im not saying I haven't broken game laws before. Maybe knowingly, maybe not. It happens and luckily I dint get caught. Ignorance of the law is not an excuse and if you knowingly break a law then your taking a risk.

I think you miss the point. Its not the agents that nit pick. They dont make the rules, just enforce them. If you feel its unfair to get a citation for something dont blame the agent. He didnt make that rule.

unfortunately, some people have to be governed. like the idiot at Fort Polk who recently had killed 4 deer that day, a buck and 3 does. One bad apple and others spoil it for the rest.
