Legal fourth shell duck hunting??

I saw an advertisement for one on a tv show an I immediately thought about its use for duck hunting. Now I realize a fourth shell would most often be a wasted shell but I got interested and just wandered about its legality.

It'll be on my gun as soon as I can find it. frick those teal that fly 1,000 mph! I'll at least hit one with 4 shots.

Or you could float your "4th" above the lifter. I know SBEII and beretta A400 and the new beretta will do it. I've never tried it with any other 3.5" gun. Pretty sure the super Vinci won't do it.

Old school SBE will float too.

My grandpa shoots 3 shells but floats a .17hmr

On the lifter - not legal, but I do it. On my M2. Matchsaver - perfectly legal. No different than a sidesaddle or one of those sleeves that holds shells on the stock. Just faster.

I'm not sure how anyone who has ever hunted ducks would need to ask this question. No, it is not legal by any stretch of the imagination.

The old SBE's and Benelli Super 90's did it out of the box. I'm not aware of the SBEII, Vinci, or Extremas doing it without some kind of modification.

I think the design was fixed around the year 2000.

Eta: And no it's not legal.

Not being sarcastic, what does page 42 explicitly state that would make this illegal? It could be compared to having a 4th shell in your hand or in a elastic band on the stock of your gun. The gun is not internally holding 4 shells that are capable of being fired without loading the fourth shell.

I'm truly interested in hearing your thoughts.

If you're so worried about an extra round, during the pre season take your plug out and rig your end cap to where you can quickly remove the plug. The end cap can be unscrewed and the plug can be quickly re-inserted after shooting with full capacity if the situation arises.

I don't do it, because ammo is so expensive I rarely shoot all three rounds, but some people want every advantage they can get no matter the legality.
