My policy is to verify employment only. In some cases, if I'm asked if the person is subject to rehire, I may say "no", but I will not give any other information. That's enough.

"I don't think what I would say about you would help you get the job. Maybe you shouldn't use me as a reference."

It's as easy as that.

Knew a guy who said "run away from "XXXX" as fast as you can". He got sued and well deserved it.

Why do you say it was well deserved? Was the employee in question a really good worker but your buddy just didn't like him?

My "buddy" was a class A prick and just loved to screw with people, which is why he totally deserved to get sued.

Did you get a decent settlement?

Even giving a positive reference can get you in trouble.

An attorney pal told me he once got an applicant rejected by giving what he thought was a glowing reference, because the positives described in the reference call fitted someone below the job opening's pay grade.

That's why I only give a reference when I know the applicant well, *really* owe them a favor, and know the details of the prospective job.

It wasn't me, but the guy giving the reference was a co-worker who I frick'n hated. He finally messed with the wrong person, got sued, then got fired. I was beyond happy.

Sure. Tell them, “You would be very lucky to get my old intern to work for you.”

I had an employee pull that on me a few years ago. I told him to do what he thought was best. Nobody ever called me regarding him.

Tell them corporate policy doesn't allow for personal references, only that you can confirm employment

To add, we never answered any questions such as this by phone. Inquires were made directly to HR by mail only.

That's his fault for asking for a reference from someone from a job he wasn't good at.

If he really was as bad as you describe, he knows it, or hes an ignorant dummy. In either case, give him what he asked for. It won't be what he was expecting, but he'll never know it. He's not asking you for a letter is he, just to be a reference? Does any company ever actually call references? Especially for new people into the workforce such as this dude?

Most interna I have encountered don’t try very hard and worse, the employer does not try hard either. A lot of people wasting each others time.

But in reality, what good is it to keep someone down that has no effect on your life?

Holding other people back from their next best opportunity is a real shitty move.

As you can plainly see from NFL Quarterbacks, they’ll flounder at one club and win the Super Bowl at another.

Give them a nice reference and forget about it.

References are dumb. I've never hired anyone based on a reference. The applicant will always give the "best of the best" when it comes to references. I assume that they are smart enough to do this. If they aren't, I don't want them working for me.

You can say you are not permitted to go beyond confirming dates of employment because people used to sue if the reference wasn't good enough to suit them.

Yeah and I have seen no correlation between how someone performs as an intern and how they perform as a real world employee. I have seen some stellar interns that when pressure is put on them at a real job they fall apart and I have seen some horrible interns that are earning more money than an operator because they are so good when it really counts.

Let him know too much time has elapsed for you to feel comfortable in doing as asked. Or, let him know you have a list of three people you give references for, period. Or, refer him to the employer at that time. Or, do as asked but tell him that he may not like it.

Tell him to send you nude pics of his wife/girlfriend and you will consider it.
