Let me get something straight: I'm out with a girl. We're both drinking. We both get drunk. We go back to my place and (drunkenly) fool around. We have drunk sex (she is awake and has said she wants it). She wakes up and freaks out that we had drunk sex. I can get charged with rape??? HOLY shite.

This thread is just sad. We were all happy when the Bama fan was arrested for sexually assaulting the lsu guy in the quarter. You can't take advantage of drunk people and being drunk isn't an excuse. You are still responsible for your actions. As always. The simple rule is dont have sex with women drunk unless you have already done it. Otherwise its going to bite you in the arse. Its not that hard and its pathetic that is the only way some guys can get some.
Legal prostitution would help alot of this..

Exactly. As things stand today, if a girl accuses a guy of rape, he's screwed, his life is over. It's pure guilty until proven innocent. And the only proof she's needs is is to say he did it.

And then when the school moves to expel you, you have to prove that
1)She was sober
2)She affirmatively consents beforehand
You drinking is no excuse, though her drinking can make the situation worse for you.
I am also happy to no longer be in college.
If I was in college, I wouldn't date other students. Wayy too dangerous. Would clear up a lot of this BS.

This isnt true at all. Rape allegations aren't just made flippantly. The girl has to make a sworn statement and be subjected to investigation before charges are filed. Police and prostecutors have to believe a crime has occurred. You know that.
Guys should just know better. Its a fine line, but you can't cross it. We've all been in that situation before. You have to just say no or just wait. Its not that complicated..

I'm not assuming shite. I was at the bar with him, where myself and another friend (jones) were repeatedly telling him not to bring her to our table because she's so obnoxiously drunk. Believe me, he was well aware. We gave him shite all night before he actually took her home because she wasn't even cute. But she was low hanging fruit.
