In LA, your insurance won't go up for filing a claim for an accident that you weren't at fault for.

If you have collision coverage on your policy, that would apply to fix your car from being hit by uninsured driver. You'd have your collision deductible applied though, so might want to get an estimate from body shop first to see if its worth the trouble of filing a claim by time your deductible is taken into account.

But I've only worked in insurance in LA...insurance laws vary from state to state so might be different in TX. Best thing is to call your agent and ask for advice before filing a claim

Why would you not call the cops? You probably would have gotten it paid for, with no premium increase, but since no cops and no report, probably wont happen. They can't just believe that you were hit by an uninsured driver, you could have done the damage yourself and just said that.

File on your UM. That's why you paid for it. The UM claim will not increase your premium, unless your record has other issues.

Commonly UM is for bodily injury, unless you are on of the very few that actually carry UMPD, (uninsured motorists property damage). We offer UMPD to folks that are carrying UMBI if they don't have collision coverage. IF the OP has collision coverage, then that is how his company is going to cover this. He will be subject to his deductible, but it should not affect his rate since it's a not-at-fault claim.

As a sidebar, UMPD is a very inexpensive coverage, (about $10 per 6 months), and carries with it a $250 deductible. It is well worth having on your vehicle if you are planning to drop your collision coverage. Of course the premium and deductible info I am spouting here are based on the company I work for, so ask your agent about your own situation.

That is a mistake - Anytime you get into an accident and it is not your fault, you want a police report - this is the only thing that is going to help you with the insurance company. Without a police report there can be disputes with what happened.

I don't get it... people pay for a service (insurance) but are scared to use it.



I say use it, and rethink the future.

Why don't you pay off you truck (if it isn't already) and buy the bare min liability insurance and start putting the rest of that monthly premium in a 'vehicular Savings Account'

I would file a claim and give the driver's info to the insurance company. Let them decide whether they want to sue. They more than likely have an attorney on retainer for that.
