Because the Federal Government is supposed to protect our rights. The constitution and the government do not grant us rights...they were put in place to protect our natural rights. Putting somebody in a cage because they hurt somebodies feelings seems to be a gross violation of those natural rights.

didn't the supreme court rule years ago that flag burning was protected under the 1st amendment? If so, not sure how a parish government thinks they can write laws that are unconstitutional.

They can write unconstitutional laws all they want. But it'll be challenged if they attempt to enforce it and will cost the Parish even more money. There are numerous state laws and civil code articles that are unconstitutional but still on the books.

But unless someone violates the ordinance and is hit with a penalty, is there really any right of action (or standing) at this point to challenge it? It's just a rule on the books for sake of the rule.

Exactly. And the sheriff in EBR arrested people for an unconstitutional law that was still on the books (but the DA didn't prosecute). But the state legislature still refuses to repeal it.

True. The parish will lose in court but they can still arrest someone, hold them for several hours, and generally frick up their day.


Even though the charges get dropped they may discourage the behavior by simply being a pain in the arse.

This is the proper stance to take if flag-burning bothers you. A true American patriot is one who supports freedom even when its the freedom of someone to do something they themselves hate.

There are tons of things people do that I loathe but I would defend their right to do them to the bitter end because the slippery slope of government intrusion isnt a slope I ski on.

I live in Iberville Parish and when I first heard this my first thought was "how many people are burning the flag in Iberville Parish?"

While I think it is extremely disrespectful to burn the American flag, I don't let it bother me when someone does it because, first of all that is what they want. People bring attention to them by getting all bent out of shape, but... I forgot what comedian it was who was talking about free speech in his standup, this was years ago, but he said "If you are going to support free speech you should realize that there will be times when people are going to say shite you don't like". In other words, you can't claim free speech when it is convenient and then get upset when people say or do shite you don't like.

I am not a lawyer, but is it even legal for a local government to make a form of free speech illegal? Like I said, I think burning the flag is completely disrespectful, but if they make that illegal, then whatever will they make illegal?
