Texas attorneys of the OT family law ??

Since this is the OT and such a fertile garden of legal advice I thought I would stater here. I know, I know, great move.

Anyway I’ve been divorced coming up on 7 years. Originally filed in Collin County moved to Dallas county a couple years later. It currently sits with the 330th judicial. We have had to modify occasionally (more than reasonable adults should but my ex is something else) in August of 2022 I agreed to allow my ex to take the 4 minor children out of state. She remarried a dude from Ohio.

My plan and understanding was Texas would remain the state of record.

My ex is trying to move the legal stuff to Ohio for the child orders.

She is claiming in her filings I am a resident of Kentucky - I am merely staying in KY with my adult son who is in the Army working on some projects and spending time with him. My intent never was to end my residency in Texas. I still plan to return within the next couple months. I work 100% remote so I can be location agnostic.

I don’t currently have a residence in Texas. In fact, I don’t have one at all. While I’m traveling I figured why bother.

I would love some advice on if she can move this thing and how I prevent it or even if it’s in my interest to try. I have no idea how Ohio versus Texas views father’s rights or how Ohio sets Child Support.

If there is a Tiger with family law background who wants to opine and we can set up a consult I’ll pay something if need be. At this point I don’t even know if I need a Texas or an Ohio attorney.

She has filed a Petition to Register Foreign Decrees whatever that means.

Also we have a hearing set up in Dallas County in my attempt to lower child support. I had agreed to a very high amount based on the children going to a specific school and then obviously living in Dallas county where visiting them wasn’t so costly.

Any young, single guys reading this be warned. Marriage is not the once great institution it was. It’s a grifting program for women.

just rent an apartment in texas and get texas drivers license / register vehicle. If you plan to move there in a few months, you would only be wasting a few months rent.

My understanding is wherever the kids are, that's where the case has to be transferred to.

I am happy my girlfriend doesn’t wants kids (I still pull out though).

This is where you fricked up. When I got divorced I locked my kids down to a specific school district. My ex can live outside of the district, so long as she can get the one remaining school-aged child to and from.

I’m no expert but I feel a lack of residence in Texas is going to hurt your case to keep the venue in Texas.

You likely have jurisdictional issues, and certainly venue, absent some other nexus to Texas.

I went through a divorce in Tn and got custody of my kids. This was a rare occurrence for any male in the county we filed but my ex was a crazy and that definitely helped. I moved my kids 1.5 hours from our original home and their mother moved an additional 1.5 hours away creating a 3 hour gap from our kids. I petitioned the court to move out of state, back to La, something she fought. Jurisdiction for the kids followed me to the new county in TN and then followed me to La. Since you gave your permission for them to move, you likely gave up jurisdiction as Jurisdiction usually follows the kids, unless something was specified and agreed upon. I am not a lawyer but that is my 2 cents.
