Pat McAfee was asked about this in an interview. The first picture he took, he was smiling and realized that there may be kids who looked up to him and he didn't want being arrested for public intoxication to be looked at as something fun. He then ended up with this.

Tiger looks like a straight up down and out thug in his. That's what mugshots are supposed to look like. Not all bright and cheery like a school picture.

I don't go into the dmv thinking I need to remember not to smile because this pic might be used as my mug shot. Even if I were to commit a crime (which I won't because I'm a good boy who diddonuthin) it would be a crime which I'd rather be smiling.

The last time I was arrested, the mugshot had to be retaken 3 times because I kept on smiling. The "STOP SMILING" command only made me grin more.

Like others have said, it depends on what you're arrested for. Most often you don't want to be seen smiling in your mug shot because the DA will say "see, he's happy about what he did". But then again, all mug shots are public and anyone can see them (and use them), so do you want a picture of yourself looking like Charles Manson out there the rest of your life. However, if you're going to jail, you need to worry about getting that arse raped more than what your next girlfriend will think...
