There hasn't been any need until recently to have a test for a sort of pot breathalyzer. Demand is now there and I think we'll see supply follow. I know they've talked about several in development.
I don't think I should be punished for taking a hit at home after work just like I shouldn't be punished for having a beer at home after work. I don't go to work drunk and if pot were legal I wouldn't go to work high.

Any job that regularly tests you is gay unless they suspect you, and if they suspect you are using drugs they should just fire you if they care. I can understand a test before you are employed but thats it.

I'll probably always be subject to random tests

This is 100% the way it should be, but it's more complicated to tell since it's in your system longer.

Of course for larger companies it depends on the CEO and/or board of directors. As the legalization is changing around the country, companies are changing.

They test because their insurance companies mandate or give lower rates, not because they like gay cock...

It's pretty common in the engineering & computer science world. At my company we only test when you're hired. But just about every other engineer or CS that I know around here gets randoms. It's standard practice for any defense contractor, same goes for civil engineering firms. Good friend of mine in Metarie works for a small eng. firm and he gets randoms.

The problem lies more in how it's treated in the face of OSHA/ADA/etc.

Not sure why these fools can go out and get hammered, but they can't smoke a blunt and chill out. They should continue to drug test but not GAF if its for marijuana

That's why I said employeement at will

Ya maybe for blue collar. In the white collar world being able to retain any talent you want is way more important than a small increase in insurance costs.

You'd be surprised. I'd bet a dollar to a dime that the CEO of Exxon mobile is drug tested regularly.

think it's just gonna take some law suits that make it to the biggest courts. there will be plenty of people that will get hemmed up due to legal weed and pee tests.
They will take legal action against it
Oregon SSC already has ruled in favor of employers, April 15 2010.
It's going to take better testing before anything changes.

Related question: can someone who is legally prescribed marijuana be fired for failing a drug test?
The case I spoke of is the situation you mentioned.

You can't be hammered at work either. The problem is that there's no easy way (yet) to test if you're stoned right now like there is for alcohol.

There would have to be a test to determine if someone was high at the point of an accident. Not just if they smoked on Saturday night and got in a wreck on Monday morning.
I disagree to a point. IQ is, of course, a poor measurement of cognition and reaction times, but consistent marijuana usage is tied to a (recoverable) ~10 point drop in IQ. Further studying, such as cognition and reaction times, has not been studied particularly closely. Thus, given THC's propensity to "hug" neurons in the brain and make them fire slower, it's not unreasonable to think that smoking on Saturday night may indeed affect your ability to function on Monday morning, particularly if you smoke Friday, Saturday, and Sunday before headed back on Monday. Now, that said, that's something that needs to be put to trial and tested once it's clear/legal to do such forms of testing. There are merits to both sides of the argument ("You can't prove it affects me" vs "You aren't functioning at full mental capacity") that does need to be looked into further before making definitive statements about whether spot-testing vs more sensitive residual testing is sufficient for determining how "impaired" a driver is.

Even if it becomes legal on the federal level I won't be able to smoke with my current company
Posted on 11/4/14 at 11:13 pm to CP3
It is tested by levels in the urine or whatever the test sample is from. Like parts per million for example. I'm sure it'll go by that kind of standard.
