Is it perfectly legal for me to follow a cop all the way to his house if he's coming home from patrol at 2:30 in the morning, just to make sure that he wasn't driving his cop cruiser to the bar and getting wasted?

Sounds like he was just doing his job.

Now if he had pulled you over just because you left a bar, then that would be messed up.

With so much animosity around the DWI thing, I think this is a great question. A few points:

1) There are indeed a few trolls who act like DWI is no big deal. Most people are more reasonable and agree that this is a problem and something the law should be effective in discouraging.

2) Reasonable people can disagree on whether the .08 BAC level is right. Personally, I think MADD is overachieving; that .08 it is too strict because the negative impact of alienating many reasonable people is worse than the aggregate increase in safety. In short, I think we should go back to .10.

3) Depite the fact that I want an aggressive police approach to DWI, I think the checkpoints are clearly unconstitutional and a violation of people who obey the law.

If I were the chief, I would create a taskforce of dedicated DWI enforcement personnel who would hang around the bars, look for probable cause in the form of traffic violations, and then take drunks off the streets. My bet is that this would net more DWI convictions (more $$, if that's how the municipalities would look at it), get more drunks off the streets, and still be constitutionally aligned.

They already have that, and the guys all make over $150k/yr. It's called the DWI Task Force. They pretty much pull over anyone they see all night long

So the state boys still do this tactic? As a kid I would get pretty nervous when it happened. Today there wouldn't be even a moments hesitation of me completely locking my brakes on the cop.

Doesn't always work. They'll pull you over regardless of legality if they really want to.

It's all about the benjamins!

If you target a bar/bars too intensely, liquor sales will decrease dramatically. Possibly putting the bar/bars out of business. Which means no more DWIs in that area.

So, the city/state loses the liquor sales tax from the bar/bars and the income from the DWIs.

Remember, this is a money based society....

$150k is obviously rich for law enforcement, but fixed, I still think this sort of thing is the best option

$150k is obviously rich for law enforcement, but fixed, I still think this sort of thing is the best option

BRPD is pretty well known to target bars so they'll pay for an off-duty detail. As soon as they get what they want, the harassment stops

BRPD aren't known for being the brightest crayons in the box. I guess it beats having to patrol Gardere or any NBR shithole.

Best thing to do in that situation is quickly nip the shenanigans in the bud. I had this happen to me a few years ago and I just pulled safely over to the shoulder of the road. I got out of the car and immediately went to my knees and locked my hands on top of my head. I didn't eyeball the peace officer one bit. I stared down at the asphalt. I knew he appreciated my submissiveness by the way he approached so slowly and casually. The sound of his boots crunching the pebbles scattered about as he slowly walked in circles around me was reassuring. I knew he was calm.... and I was safe. This one was a protector and not a predator. He slid his baton under my chin and gently lifted my head and gave me permission to rise. After checking my papers and making sure I was not drunk he let me go with only a warning.

Never invite an officer to approach you for further harassment.

You probably saved several other people from being extorted that night.
