It is completely legal for cops to watch you leave a bar and follow you. However, they can only pull you over if you violate a traffic law or show signs of intoxication while leaving the bar or driving.

This is true. They do have to have a reason to pull you over i.e. traffic infraction, but if they see you leaving the bar, they will not only follow you but will include in their report that they saw you leave the bar and will use it against you if you take your case to trial.

Is it legal for a cop to pull you over for no reason other than to check to see if you're drunk?

I was pulled over sober once and given the field sobriety test which I passed. He said he pulled me over for an out tail light. When I checked the next day all my lights worked fine.

He needs reasonable suspicion to pull you over for a "Terry stop"! God I hate law school.

Thank you for wasting taxpayer dollars and "fricking around" with a cop that is trying to keep our streets safe. He might have missed a dangerous suspect as you were acting like a 14 year old.

Yes. They are.

What would you do or what are you supposed to do in that situation?

I would drive home like a fricking grown-up.

Should have pulled over and asked him what is problem was for tailgating you.

The "Don't drink and drive" ads are about how "expensive" DUI's are. Not about the dangers they possess to the public.

good strategy, IMO.

People are perfeclty aware of the health risks of smoking but that sure doesn't stop people from doing it. For not very bright people who dont' see any issues with DUI, seeing a commercial saying how many lives it takes doesn't do a damn thing. For that type of person, an ad saying "hey, if you get a DUI it's going to cost you at least $10,000" is probably more effective at getting them to think about it for a minute.

Aren't you cute...

Cops do whatever the frick they want. They just have to say "I saw you swerve over the middle line" and they can pull you over.

It happens every day in this country.

In Oxford, MS the cops are fricking nuts about busting kids driving drunk. There is no other crime to worry about really.

I was pulled over sober no less than 10 times in college just leaving the library late or DD’ing for friends. One time, he made me pass a field sobriety test, then breathalyzer, THEN searched me, THEN searched my passengers, THEN brought K9 unit out (which he didn’t even take out of the car, just a scare tactic), before finally telling me I better watch out or he was going to get me.

My crime you ask? Sitting in a loading zone in front of the bar waiting for friends to come out so I could safely bring them home. And I had my emergency flashers on. I had been studying all night and was in sweatpants and a t-shirt.

God I fricking hate cops.

Solid ending to the story though was the line of people going into the bar gave me an ovation when they let me go.

An OT baller would have stopped, asked him what his problem was and informed him that he was taking his kids home. When he proceeded back to his cruiser, yell to him, "hey, be safe and quit tailgating...and have a great night" while slamming your door (kids are all in the back videoing the whole thing). Cop=owned

I would have been strongly tempted to do this. Of course, it's his job to follow someone he suspects may be drunk but tailgating isn't the safest way to go about it.

I can't see too well when people tailgate me at night. I would have stopped and got out of the car and hoped for the best (kids all videoing of course).

In previous DUI threads, I have mentioned that some people want to legalize marijuana which will only add to the number of unsafe drivers on the road. I get a lot of down votes.

You are right about people ignoring the reality of a situation when logic goes against what they want to do.

They seem to be saying that other people need to drive safely but they are willing to take chances.

P.S. Any vote counts, up or down. It shows that I have involved the readers in the discussion.

Reckless driving. Could have pulled you over.

It's a good way to start a great misunderstanding. Best thing you could have done was stop at a 24 hour gas station in a well lit area. He can keep following you if he wants or he can talk to you in the parking lot. Either way, the situation is diffused in a public area. Also, the chances of someone taking a video of you getting protected and served are much greater.

Which means jack shite. They will pull you over with no cause at 2 am and make something up. It's how they fish.

If they watch you exit the bar, get in your car, and drive off and stop you for no reason and give you a DWI, it would get thrown out due to entrapment (if I'm not mistaken). He was waiting for you to frick up so he could stop you with just cause

As with every decision I make day to day, I ask myself which course of action will create the least amount of headache for me....and do that.
