OT Lawyers and Cops question

So finally after two years of going through the same intersection every day I finally got popped on the photo enforced bullshite.

They make it extremely inconvenient to fight it so I paid the 75 bucks already. This morning however got me to thinking.

The charge on the mail was failure to stop at a red light.

The intersection is 4 lanes in which lane 4 (the one I was in) is a dedicated right turn lane.

I watched the video they have and at the start it shows a van stopped in front of me at the light, then makes his right turn. I follow behind him and start to inch forward to check to see if any there's any oncoming traffic (which there was not) and make my turn. From the time stamp it takes 3 seconds to complete the maneuver.

Could I have argued that I was clearly stopped at a red light due to the fact I was behind someone at the start of the video and only moved to check and make my turn?

Well I don't want a bench warrant for a fricking traffic ticket.

And to be quite honest, I am not sure how these photo enforcement shits work. There was a cop and his badge number listed in the documentation from Irving PD

Red light companies are like beggars at a stop light. Giving them money just encourages them to harass others. Cut them off and they will go away.

I got one here in West Palm, fought it and while mine was pending they declared them unconstitutional under Florida law. Case dismissed

Texas traffic code says:

An operator of a vehicle facing only a steady red signal shall stop at a clearly marked stop line. In the absence of a stop line, the operator shall stop before entering the crosswalk on the near side of the intersection. ... After stopping, standing until the intersection may be entered safely, and yielding right-of-way to pedestrians lawfully in an adjacent crosswalk and other traffic lawfully using the intersection, the operator may:

(1) turn right;

I've had three of these camera tickets sent to my house. I throw them in the trash upon arrival. They would send me about three notifications per ticket claiming they were going to turn me over to collections etc. I never acknowledged that I received the letters and I have suffered no consequences. I don't think they can create a bench warrant for camera tickets.

I wish there was a way to post the avi.

Without arguing things such as the degree of the turn, obstruction of view, blah blah blah....

The answer is I was at a complete stop behind the van at the red light. He turned, I moved up, inched forward to check (due to obstructions), and made my turn.

But no you are right once it was my time to turn even if it was inching forward to check traffic, I did not come to a complete stop to make my turn.

I believe you. I also watch too much LivePD and dont want to be one of those frickheads who are shocked when they say they have a warrant out. This is my kind of luck lol.

Your argument should be that they cannot prove that it was you driving...not that the maneuver was legal.

The burden of proof is on them to prove who the driver was and they can't cite the vehicle for a moving violation

They won't put a bench warrant out for the camera tickets, but if you use public parking they will tow your car and hold it until you pay for the tow and the outstanding tickets. It's complete BS

Good analogy, but at least the beggars provide a sense of charity in the contributor. In that way, they're actually better than these fricking scum scam companies.

this. Have several camera tickets myself from around Nola, Gretna, Kennah, etc over the yrs. Use private garages to make sure I'm not booted/towed.

I tell my kids to always stop 2 times at these intersections for this reason
