Man sues Zephyrs for going blind from foul ball, wife isn't getting sex

Isn't this a known risk from going to baseball game?
"Don Wilson said he was seated behind the 3rd base dugout, when a foul ball flew off a handrail, hitting him in the right eye on May 6, 2014. That area had no protective netting, according to the lawsuit.
Barbara Wilson said she has "suffered loss of love, sex and society and is entitled to compensation"

Yup. Each ticket says something about assuming the risk. The only way you can sue for something like this is if you are behind the protective netting and it fails.

WTF? Has the guy ever watched or been to another baseball game? The only place they have protective netting is directly behind home plate. Everywhere else is fair game. That's on him.

The "deprived of sex" is pretty vomit in personal injury cases. (along with anything else the lawyer can think of)

Edit: I'm saying crank up your frivolous lawsuit radar when you see filing dates 364 days after the incident. I think some people took it as me saying it was old news.
